About measures for implementation of the Presidential decree of the Russian Federation of November 15, 2021 No. 657

In pursuance of Item 1 of the Presidential decree of the Russian Federation of November 15, 2021 "About rendering humanitarian support to the population of certain districts of the Donetsk and Luhansk regions of Ukraine" the Government of the Russian Federation decides No. 657:

1. Approve enclosed:

changes which are made to acts of the Government of the Russian Federation;

the list of check points through frontier of the Russian Federation through which movement of goods in the territory of the Donetsk People's Republic, the Luhansk People's Republic or from the specified states without application of quantitative restrictions of export and import is performed.

2. Recognize in the Russian Federation valid the certificates of origin issued by authorized bodies (organizations) of the Donetsk People's Republic, the Luhansk People's Republic, constituted in the form established by the Rules of determination of the country of goods' origin which are integral part of the Agreement on Rules of determination of the country of goods' origin in the Commonwealth of Independent States of November 20, 2009 and according to the criteria of determination of the country of goods' origin provided by the specified Rules.

3. To federal executive bodies by preparation of drafts of legal acts of the Russian Federation about introduction of quantitative restrictions of export and commodity import to consider provisions of this resolution.

4. To the Ministry of Finance of the Russian Federation in 2 weeks time to bring the regulatory legal acts into accord with this resolution.

5. This resolution becomes effective from the date of its official publication.

b) Item 2 (to add 1) after the words "except for state members of the Eurasian Economic Union" with the words "and certain districts of the Donetsk and Luhansk regions of Ukraine";

c) Items 3 - 3(2) to state in the following edition:

"3. Confirmation of country of source of the medical products included in the list No. 1 and the list No. 2, is the certificate of origin issued by authorized body (organization) of state members of the Eurasian Economic Union or the certificate of origin issued by authorized bodies (organizations) which are actually operating in the territories of certain districts of the Donetsk and Luhansk regions of Ukraine for the form established by the Rules of determination of the country of goods' origin which are integral part of the Agreement on Rules of determination of the country of goods' origin in the Commonwealth of Independent States of November 20, 2009 (further - Rules), and according to the criteria of determination of the country of goods' origin provided by Rules.

Confirmation of percentage cost portion of the used materials (raw materials) of foreign origin in the price of end products is the appraisal certificate issued by Chamber of Commerce and Industry of the Russian Federation containing information on cost portion of the foreign materials (raw materials) used for production of one unit of medical product calculated according to the subitem "v" of Item 2.4 of Rules or the similar document issued by the authorized body (organization) of state member of the Eurasian Economic Union or authorized body (organization) which is actually operating in the territories of certain districts of the Donetsk and Luhansk regions of Ukraine.

3(1). In case of execution of the contract in case of which conclusion were rejected according to the restrictions of the request set by this resolution which contain offers on delivery of separate types of the medical products included in the list No. 1 and coming from foreign states (except for state members of the Eurasian Economic Union and the territories of certain districts of the Donetsk and Luhansk regions of Ukraine), replacement of medical product by medical product which country of source is not the state member of the Eurasian Economic Union or the territory of certain districts of the Donetsk and Luhansk regions of Ukraine and replacement of the producer of medical product are not allowed.

3(2). In case of execution of the contract in case of which conclusion were rejected according to the restrictions of the request set by this resolution the containing offers on delivery of medical products of single application (use) from the polyvinyl chloride plastics and other plastics, polymers and materials included in the list No. 2 and coming from foreign states (except for state members of the Eurasian Economic Union and the territories of certain districts of the Donetsk and Luhansk regions of Ukraine), replacement of medical product by medical product which country of source is not the state member of the Eurasian Economic Union or the territory of certain districts of the Donetsk and Luhansk regions of Ukraine or percentage cost portion of the used materials (raw materials) of foreign origin in the price of end products of which is more than self-produced localization of medical products specified in indicator for the corresponding year, and replacement of the producer of medical product are not allowed.".
