About approval of the Regulations on licensing of activities for storage and trade in civil and office weapon and the main parts of firearms, cartridges to civil and office weapon and components of cartridges (except for the specified activities performed by military units and the organizations of the Armed Forces of the Russian Federation and troops of national guard of the Russian Federation if implementation of the specified activities is provided by their constituent documents)

According to the Federal Law "About Licensing of Separate Types of Activity" Government of the Russian Federation decides:

1. Approve the enclosed Regulations on licensing of activities for storage and trade in civil and office weapon and the main parts of firearms, cartridges to civil and office weapon and components of cartridges (except for the specified activities performed by military units and the organizations of the Armed Forces of the Russian Federation and troops of national guard of the Russian Federation if implementation of the specified activities is provided by their constituent documents).

2. This resolution becomes effective since March 1, 2022.

Regulations on licensing of activities for storage and trade in civil and office weapon and the main parts of firearms, cartridges to civil and office weapon and components of cartridges (except for the specified activities performed by military units and the organizations of the Armed Forces of the Russian Federation and troops of national guard of the Russian Federation if implementation of the specified activities is provided by their constituent documents)

1. This Provision establishes procedure for licensing of activities for storage and the trade in civil and office weapon and the main parts of firearms, cartridges to civil and office weapon and components of cartridges (except for the specified activities, performed by military units and the organizations of the Armed Forces of the Russian Federation and troops of national guard of the Russian Federation, if implementation of the specified activities is provided by their constituent documents) performed by legal entities in the territory of the Russian Federation (further - the activities which are subject to licensing).

2. Licensing of the activities which are subject to licensing is performed by the Federal Service of troops of national guard of the Russian Federation and its territorial authorities (further - the licensing body).

3. The activities which are subject to licensing include the following works (services):

a) on storage of civil and office weapon and the main parts of firearms (further - weapon);

b) on arms trade;

c) on storage of cartridges to civil and office weapon and components of cartridges (further - cartridges);

d) on trade in cartridges.

4. In case of performance of works (rendering the services) specified in the subitem "an" of Item 3 this provision, and (or) works (services) specified in the subitem "v" of Item 3 this provision within implementation of the activities which are subject to licensing the following licensed requirements are imposed to the license applicant or the licensee:

a) availability of the declared works (rendering the services) meeting the requirements to acceptance, accounting, storage, providing conditions of safety of weapon and (or) cartridges and exception of access for strangers to weapon and (or) the cartridges established by the Rules of turnover of civil and office weapon and cartridges to it in the territory of the Russian Federation approved by the order of the Government of the Russian Federation of July 21, 1998 No. 814 "About measures for regulation of turnover of civil and office weapon and cartridges to it in the territory of the Russian Federation" belonging to the license applicant or the licensee on the property right or other legal cause of the rooms, buildings, constructions necessary for accomplishment;

b) availability in staff of the license applicant or the licensee of the workers responsible for safety, storage and accounting of weapon and (or) the cartridges conforming to requirements of part seven of article 22 of the Federal law "About Weapon";

c) ensuring accounting of weapon and (or) cartridges, and also conditions for safety, safety of storage of weapon and (or) cartridges and exception of access for strangers to weapon and (or) cartridges according to articles 22 and 25 of the Federal law "About Weapon".

5. In case of performance of works (rendering the services) specified in the subitem "b" of Item 3 this provision, and (or) works (services) specified in the subitem "g" of Item 3 this provision within implementation of the activities which are subject to licensing the following licensed requirements are imposed to the license applicant or the licensee:

a) availability of the declared works (rendering the services) meeting the requirements to acceptance, accounting, storage and pre-sale preparation of weapon and (or) cartridges, providing conditions of safety of weapon and (or) cartridges and exception of access for strangers to weapon and (or) the cartridges established by the Rules of turnover of civil and office weapon and cartridges to it in the territory of the Russian Federation approved by the order of the Government of the Russian Federation of July 21, 1998 No. 814 "About measures for regulation of turnover of civil and office weapon and cartridges to it in the territory of the Russian Federation" belonging to the license applicant or the licensee on the property right or other legal cause of the trade rooms, buildings, constructions and trading equipment necessary for accomplishment;

b) availability in staff of the license applicant or the licensee of the workers responsible for safety, accounting and storage of weapon and (or) cartridges, and also performing functions connected with sale, pre-sale preparation, transfer and transportation of weapon and (or) the cartridges conforming to requirements of part seven of article 18 of the Federal law "About Weapon";

c) ensuring accounting of weapon and (or) cartridges, and also conditions for safety, safety of storage of weapon and (or) cartridges and exception of access for strangers to weapon and (or) cartridges according to articles 22 and 25 of the Federal law "About Weapon".

6. The failure to carry out by the licensee of the licensed requirements provided by items 4 and the 5th this provision, which entailed the effects provided by part 10 of article 19.2 of the Federal law "About Licensing of Separate Types of Activity" is gross violation of such requirements.
