About approval of the Procedure for holding poll concerning the initiatives directed to the solution of questions of public administration in different spheres of public life on the Single state web portal of electronic services

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for holding poll concerning the initiatives directed to the solution of questions of public administration in different spheres of public life on the Single state web portal of electronic services which is attached.

2. To provide to the ministry of digital transformation in three-months time technical capability of holding poll on the Single state web portal of electronic services, including with use of mobile application of the Single state web portal of electronic services (Action).

3. Item 4 of the Regulations on the Ministry of digital transformation of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of September 18, 2019 No. 856 "Questions of the Ministry of digital transformation" (Official Bulletin of Ukraine, 2019, No. 80, Art. 2736), to add with subitem 11-2 of the following content:

"11-2) carries out by means of the Single state web portal of electronic services, including with use of mobile application of the Single state web portal of electronic services (Action), poll concerning the initiatives directed to the solution of questions of public administration in different spheres of public life;".

Procedure for holding poll concerning the initiatives directed to the solution of questions of public administration in different spheres of public life on the Single state web portal of electronic services

1. This Procedure determines the mechanism of holding poll concerning the initiatives directed to the solution of questions of public administration in different spheres of public life (further - poll), on the Single state web portal of electronic services (further - the Action Portal).

Action of this Procedure extends to the technical administrator and the owner of the Action Portal which is the organizer of poll (further - the organizer), and also to initiators and survey participants.

2. In this Procedure terms are used in such value:

the questionnaire for poll (further - the questionnaire) - the list of questions created by the technical administrator on which the participant provides the answer;

the order for holding poll (further - the order) - the address of the initiator of poll stated electronically concerning the organizer of holding poll;

the initiator of poll (further - the initiator) - the ministry, another central or local executive body, submitted the order for holding poll to Mintsifry;

survey results - total quantity of answers of participants on each of the options offered in the questionnaire;

survey participants (further - participants) - users of the Action Portal, and also mobile application of the Action Portal (Action) which performed 14 years and who showed willingness to pass poll on the Action Portal.

3. Poll is information collection which is carried out with research purpose of general opinion (line item) of the population concerning the initiatives directed to the solution of questions of public administration in different spheres of public life.

Poll is not the vote provided by the Law of Ukraine "About All-Ukrainian referendum" and is not the elections provided by the Electoral code of Ukraine.

Poll is not form of public public discussion and/or the electronic consultations with the public provided by the Procedure for carrying out consultations with the public concerning forming and realization of state policy approved by the resolution of the Cabinet of Ministers of Ukraine of November 3, 2010 No. 996 "About ensuring participation of the public in forming and realization of state policy" (The Official Bulletin of Ukraine, 2010, No. 84, the Art. 2945).

4. Survey is conducted electronically by means of the Action Portal, including with use of mobile application of the Action Portal (Action).

5. Survey is conducted according to the decision of the organizer on own initiative or according to the orders provided by initiators in form according to appendix.

6. Orders move to the organizer signed by the head of relevant organ or the deputy manager concerning digital development, digital transformation and digitalization (CDTO) electronically with use of system of electronic interaction of executive bodies.

Orders move not more often than once a month or in other time under written approval of the organizer.

7. In the order data on availability of additional materials, including audiovisual materials, and information on their placement on web resources and access to them are specified.

8. The organizer checks the submitted order for compliance to the requirements established by this Procedure.

If the order is submitted with violation of the requirements established by this Procedure, the organizer can refuse holding poll.

In case of decision making about provision of failure in holding poll the organizer no later than within three working days after receipt of the order returns it to the initiator together with the cover letter with indication of the reason.

9. At the same time several surveys on different questions can be conducted.

10. Survey is conducted in the terms established by the technical administrator taking into account the order.

In case of submission of the order is later than in 10 days prior to the date of poll specified in the order the specified start date of holding poll can be postponed for the term established by the technical administrator taking into account technical capability. The technical administrator informs the initiator on transfer of date of poll not later than within two working days from the date of such transfer.

11. Survey can be conducted for all users of mobile application of the Action Portal (Action) or for separate categories of users according to the order.

12. For holding poll among separate categories of persons the depersonalized personal data of such persons during the time determined by this Procedure can gather and be stored.

13. Survey is conducted by filling with the participant of the questionnaire created by means of the Action Portal, in particular mobile application of the Action Portal (Action).
