For the purpose of realization of pilot project on implementation of the mechanism of traceability of the goods imported on customs area of the Eurasian Economic Union concerning the goods included in the inventory approved by the Decision of Council of the Eurasian economic commission of January 21, 2022 No. 2, and according to Articles 4, 5 and 11 Agreements on the mechanism of traceability of the goods imported on customs area of the Eurasian Economic Union of May 29, 2019 (further - the Agreement) Council of the Eurasian economic commission solved:

1. Approve the enclosed Procedure for inclusion and storage in national systems of traceability of data on the goods imported on customs area of the Eurasian Economic Union and subjects of traceability.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Procedure for inclusion and storage in national systems of traceability of data on the goods imported on customs area of the Eurasian Economic Union and subjects of traceability

1. This Procedure determines rules and terms of inclusion and storage in national systems of traceability of data on the goods imported on customs area of the Eurasian Economic Union and subjects of traceability (further - goods).

2. Data from the documents specified in subitems 1 and 3 of Item 1 of article 5 of the Agreement on the mechanism of traceability of the goods imported on customs area of the Eurasian Economic Union of May 29, 2019 (further - the Agreement), join in national system of traceability no later than the day following behind day of date of issue of goods or creation of the accompanying document.

In case of movement of goods according to commission agreements, orders, storages, the contract, finance lease (leasing), commercial loan, rendering logistics services, including movement of goods of exhibitions, fairs (from exhibitions, fairs), from the territory of one state member of the Eurasian Economic Union (further - state member) on the territory of other state member which is not connected with sales of goods, data from documents on movement of such goods based on item 4 of article 4 of the Agreement join in national system of traceability no later than the day following behind day of creation of the accompanying document if such inclusion is stipulated by the legislation state member.

3. Data from national systems of traceability of other state members join in national system of traceability of state member or in the system of state member intended for storage of data from national systems of traceability no later than 60 minutes from the moment of their obtaining.

4. Storage in national systems of traceability of data on the goods and transactions connected with their turnover stops after 5 years from the date of inclusion in national system of traceability of data on the last transaction connected with turnover of goods and if such transactions were not performed, - after 5 years from receipt date in national system of traceability of data from the declaration on goods or from the statement for release of goods before submission of the declaration on goods on which such goods were placed under customs procedure of release for internal consumption, or from the documents specified in the subitem 2 of Item 1 of article 5 of the Agreement.

5. In addition to cases, certain Item 1 of article 11 of the Agreement, allows movement of goods from the territory of one state member on the territory of other state member in case of absence in national system of traceability of data on the transactions connected with such movement for the purpose of the prevention and natural disaster response, emergency situations of natural and technogenic nature.

Procedure for movement of goods in the cases specified in this Item and the list of accompanying documents are determined by the legislation of state members.

6. Movement of goods from the territory of one state member on the territory of other state member in case of absence in national system of traceability of data on the transactions connected with such movement, in connection with the defect of information systems caused by technical failures, violations in operation of means of communication (telecommunication networks and the Internet), electricity outage can be performed with use of the accompanying documents constituted on papers during the period from the moment of emergence of such circumstances and before their elimination.

Public authority of state member, authorized to provide collection, accounting, storage and processing of the data included in national system of traceability, and (or) realization of the mechanism of traceability informs public authorities of other state members with use of available methods of information transfer, authorized to provide collection, accounting, storage and processing of the data included in national system of traceability, and the Eurasian economic commission about emergence of the corresponding circumstances with indication of date and time of their identification and also on their elimination within 60 minutes from the moment of identification (elimination) of these circumstances.
