About transitional provisions of the technical regulation of the Eurasian Economic Union "About safety of railway vehicles of the subway" (TR EEU 052/2021)

According to Item 2 of article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014, Item 11 of appendix No. 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, taking into account the paragraph of the fifth Item 38 of the Procedure for development, acceptance, change and cancellation of technical regulations of the Eurasian Economic Union approved by the Decision of Council of the Eurasian economic commission of June 20, 2012 No. 48, Board of the Eurasian economic commission solved:

1. Determine that:

a) documents on assessment of conformity of products to the mandatory requirements established by the acts entering the right of the Eurasian Economic Union (further - the Union), or the legislation of state member of the Union (further - state member), issued or accepted concerning products which are object of technical regulation of the technical regulation of the Eurasian Economic Union "About safety of railway vehicles of the subway" (before the date of entry into force of the technical regulation, are valid TR EEU 052/2021) (further respectively - products, the technical regulation) before the termination of term of their action, but no later than 24 months from the effective date of the technical regulation.

From the effective date the technical regulation issue or adoption of documents on assessment of conformity of products to the mandatory requirements which are earlier established by the acts entering the right of the Union or the legislation of state member is not allowed;

b) within 24 months from the effective date of the technical regulation production and release into the stream of commerce on customs area of the Union of products which were not subject before the date of entry into force of the technical regulation to obligatory assessment of conformity to the mandatory requirements established by the acts entering the right of the Union or the legislation of state member without documents on obligatory assessment of conformity of products and not marked national mark of conformity (market access mark) are allowed;

c) within 24 months from the effective date of the technical regulation production and release into the stream of commerce on customs area of the Union of products according to the mandatory requirements which are earlier established by the acts entering the right of the Union or the legislation of state member in the presence of the documents on assessment of conformity of products specified to mandatory requirements, issued or accepted before the date of entry into force of the technical regulation are allowed.

Products are marked by national mark of conformity (market access mark) according to the legislation of state member. Marking of such products single market circulation mark of the Union is not allowed;

d) the product circulation, specified in subitems "b" and "v" of this Item, is allowed during the service life established according to the legislation of state member.

2. Ask the Government of the Russian Federation to provide together with state members development and submission to the Eurasian economic commission before the date of entry into force of the technical regulation:

a) the draft of the program for development (modification, review) of interstate standards as a result of which application on voluntary basis observance of requirements of the technical regulation, and the interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation and implementation of assessment of conformity of objects of technical regulation to requirements of the technical regulation is provided;

b) the draft of the list of products which are subject to obligatory assessment of conformity to requirements of the technical regulation concerning which when placing under customs procedures observance of measures of technical regulation proves to be true.

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.
