About approval of rules of realization of general processes in the field of provision of pensions of workers of state members of the Eurasian Economic Union

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of December 19, 2016 No. 169 "About approval of the Procedure for realization of general processes within the Eurasian Economic Union", the Board of the Eurasian economic commission solved:

1. Approve the enclosed Rules of realization of general processes in the field of provision of pensions of workers of state members of the Eurasian Economic Union.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Rules of realization of general processes in the field of provision of pensions of workers of state members of the Eurasian Economic Union

I. General provisions

1. These rules determine requirements to realization of general processes within the Eurasian Economic Union (further - the Union) in the field of provision of pensions of workers of state members of the Eurasian Economic Union (further respectively - general processes, workers, state members), the functions performed in case of realization of the general processes by their participants, procedure for exchange of information between them, and also the scope of information transferred and published on information portal of the Union in case of realization of general processes.

These rules are developed for the purpose of implementation of the Pension provision agreement of workers of state members of the Eurasian Economic Union of December 20, 2019 (further - the Agreement) and the Order of interaction between authorized bodies, competent authorities of state members of the Eurasian Economic Union and the Eurasian economic commission on application of regulations of the Pension provision agreement of workers of state members of the Eurasian Economic Union of the December 20, 2019 approved by the Decision of Council of the Eurasian economic commission of December 23, 2020 No. 122 (further - the Procedure).

2. For the purposes of these rules concepts which mean the following are used:

"additional medical data" - the data on physical examination of the worker requested and provided in addition for the solution of question of establishment to the worker of disability;

"request of data" - the data important for provision of pensions of working (family members), heirs (legal successors) of the pension accruals, persons applying for receipt of the pension which is not received by working (family member) in connection with death;

"applicant" - the participant of provision of pensions or its representative who filed in competent authority of state member petition for appointment and pension payment;

"data within transfer of pension" - the data necessary for pension payment represented by the competent authority of state member which granted pension;

"data for establishment and pension payment" - the data and documents necessary for confirmation of the right to provision of pensions;

"data on deduction completion" - data on completion of deduction of excessively paid amount of pension by the competent authority of state member which performed deduction;

"data on significant circumstances" - data on the circumstances attracting change of the size of pension, the termination or renewal of its payment, and also change of personal data of working (family member) and other circumstances important for application of the Agreement which are subject to bringing to data of competent authority of other state member;

"data on physical examination" - data on physical examination of the worker and the copy of medical documents in electronic form which submission is necessary for conducting medico-social examination (complex survey, re-examination) in case of the request for pension in connection with disability;

"data on pension delivery confirmation" - the data on payment (the nonpayment reason) of pension represented by the competent authority performing delivery of pensions;

"data on length of service" - the data confirming availability of length of service of the worker in the territory of state members;

"data on the reconciliation statement" - the data necessary for providing reconciliation of the paid pensions sent to competent authority of state member according to Procedure Items 25 and 26;

"data on deduction of excessively paid amount of pension" - data on excessively paid amounts of pension to working (family member) which are subject to deduction according to Procedure Item 28;

"the notification on the made decision" - data on the decision on appointment made by competent authority of state member (refusal in appointment) pensions to working (family member), establishment (refusal in establishment) to the worker of disability, deduction (impossibility of deduction) of excessively paid amount of pension, payment (refusal in payment) pensions to person having the right to the pension added, but not received by working (family member) in connection with death;

"the participant of provision of pensions" - working (family member), the heir (legal successor) of pension accruals, person applying for receipt of the pension which is not received by working (family member) in connection with death.

Other concepts used in these rules are applied in the values defined by the Agreement on the Eurasian Economic Union of May 29, 2014, the Agreement, Procedure and acts of bodies of the Union concerning creation and development of the integrated information system of the Union (further the integrated system).

II. Purposes and tasks of realization of general processes

3. The purposes of realization of general processes are:

a) ensuring exchange of data between competent authorities of state members (further - competent authorities) for establishment and pension payment to working (family member);

b) ensuring exchange of data between the competent authorities necessary for confirmation of labor activity of the worker, for the purpose of removal from working (member of the family) of encumbrance on data presentation of data;

c) possibility of obtaining by the Eurasian economic commission (further - the Commission) information from authorized bodies of state members (further - authorized bodies) and competent authorities, necessary for realization of powers on monitoring of execution of the Agreement and the Procedure.

4. For goal achievement of realization of general processes it is necessary to solve the following problems:

a) provide operational exchange of legally significant electronic documents and data between competent authorities in case of establishment and pension payment to working (family member);

b) provide operational exchange of legally significant electronic documents and data between competent authorities for the purpose of pension payment to working (family member);

c) provide possibility of obtaining by the Commission from authorized and competent authorities of data for the purpose of implementation of monitoring of execution of the Agreement and the Procedure;

d) provide use by participants of general processes of single qualifiers and reference books.

III. Participants of general processes and their function

5. Participants of general processes are:

competent authorities;

authorized bodies;

Commission.

6. Competent authorities perform the following functions:

a) within realization of general process "Ensuring exchange between competent authorities of state members of the Eurasian Economic Union the electronic documents and (or) data necessary for establishment and pension payment to workers (members of their families)":

submission to competent authorities of other state members for which pension the participant of provision of pensions, the data for establishment and pension payment, including data on physical examination and data on length of service applies;

sending an inquiry of data, including data on length of service;

submission of the additional data and documents important for provision of pensions of the participant of provision of pensions, including additional medical data and documents, and also data on length of service in the territory of the state member at the request of competent authority of other state member;

the direction of the notification on the made decision;

representation to competent authority of other state member of data on significant circumstances;

b) within realization of general process "Ensuring exchange of electronic documents and (or) data between competent authorities of state members of the Eurasian Economic Union for the purpose of pension payment to workers (members of their families)":

submission to the competent authorities performing delivery of pensions, data within transfer of pension;

submission to the competent authorities which granted pension, data on pension delivery confirmation;

submission to the competent authorities making transfer of pensions, data on the reconciliation statement;

submission to the competent authorities performing delivery of pensions, data on confirmation of data on the reconciliation statement;

submission to competent authority of other state member of data on deduction of excessively paid amount of pension;

submission to the competent authority which directed data on deduction of excessively paid amount of pension, the notification on the made decision;

the notification of the competent authority which directed data on deduction of excessively paid amount of pension, data on deduction completion.

7. Within realization of general processes authorized and (or) competent authorities represent to the Commission on annual basis (no later than April 1 of the year following after accounting year as of January 1) data on the number of receivers of the pensions (by types of pensions) granted according to the Agreement, and amounts of the spent funds for pension payment exported in the territory of other state members (by state members) (further - the generalized data), and also at the request of the Commission - information relating to subject of regulation of the Agreement and the Procedure.

8. Within realization of general processes the Commission performs monitoring of execution of the Agreement and the Procedure based on the data received from authorized and (or) competent authorities and information, and also their publication on information portal of the Union.

9. Information exchange in case of realization of general processes is performed according to function charts according to appendix No. 1.

IV. Information resources and services

10. Within realization of general processes forming of general information resources in the field of provision of pensions is not provided.

11. Authorized and (or) competent authorities perform forming and maintaining national information resource in the field of provision of pensions according to the legislation of state member.

12. The commission performs forming and maintaining the thematic Section "Provision of Pensions within the Eurasian Economic Union" (further - the thematic Section) on information portal of the Union containing the following categories of data:

a) information on the international treaties entering the right of the Union, acts of bodies of the Union in the field of provision of pensions (in the form of details of documents and references to the legal portal of the Union), and also about other international acts of the third countries and the international regional associations (in the form of details of documents and references to official sources of publication);

b) data on the main regulatory legal acts of state members, international treaties in the field of provision of pensions (in the form of details of documents and references to appropriate sections of the official sites of authorized bodies);

c) data on authorized and (or) competent authorities, including their contact information and references to the official websites on which data on procedures of registration and receipt of pension in each state member are posted;

d) the generalized data by state members and on the Union in general on annual basis;

e) topical issues in the field of provision of pensions and answers to them.

13. On information portal of the Union access of authorized and (or) competent authorities to services of personal account for the publication of the data specified in subitems "b" and "v" of Item 12 of these rules is provided.

V. Features of information exchange

14. Information exchange between competent authorities, and also between authorized and (or) competent authorities and the Commission within realization of general processes is performed in electronic form with use of the integrated system (except for the data specified in subitems "an" - "in" and "д" Item 12 of these rules).

15. Information exchange is performed in Russian.

16. Information exchange between competent authorities, and also between authorized and (or) competent authorities and the Commission within realization of general processes is performed according to requirements of the technological documents regulating such interaction, including determining format and structure of electronic documents (data) approved by Board of the Commission.

17. The scope of information, transferred between competent authorities, and also between authorized and (or) competent authorities and the Commission, is determined according to requirements according to appendix No. 2.
