About procedure for enforcement of the changes made to technical regulations of the Customs union "About safety of railway rolling stock" (TR CU 001/2011), "About safety of high-speed rail transport" (TR CU 002/2011) and "About safety of infrastructure of rail transport" (TR CU 003/2011) the Decision of Council of the Eurasian economic commission of September 14, 2021 No. 90

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 11 of appendix No. 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Board of the Eurasian economic commission solved:

1. Determine that:

a) documents on assessment of conformity of products which are object of technical regulation of technical regulations of the Customs union "About safety of railway rolling stock" (TR CU 001/2011), "About safety of high-speed rail transport" (TR CU 002/2011) and "About safety of infrastructure of rail transport" (TR CU 003/2011) accepted by the Decision of the Commission of the Customs union of July 15, 2011 No. 710 (taking into account the changes made by the Decision of Council of the Eurasian economic commission of September 14, 2021 the No. 90) (further - technical regulations) issued or accepted till April 6, 2022 are valid before the termination of term of their action;

b) production and release into the stream of commerce on customs area of the Eurasian Economic Union of products which are object of technical regulation of technical regulations in the presence of the documents on assessment of conformity specified in the subitem "an" of this Item are allowed before the termination of effective period of such documents;

c) till April 8, 2024 production and release into the stream of commerce in the territories of state members of the Eurasian Economic Union of products (except for high-speed railway rolling stock) which were not subject till April 6, 2022 to obligatory assessment of conformity to the mandatory requirements established by the acts entering the right of the Eurasian Economic Union or the legislation of state member of the Eurasian Economic Union without documents on obligatory assessment of conformity of products and not marked national mark of conformity (market access mark) are allowed;

d) the product circulation, specified in subitems "b" and "v" of this Item, is allowed during service life of these products;

e) in case of certification of products for the purpose of confirmation of its compliance to requirements of technical regulations for the decision of certification body results of the testing of certified production which are carried out or begun till April 6, 2022 taking into account the features established by technical regulations can be considered.

The specified testing can be considered in case of certification only if by their results the essential changes requiring carrying out repeated researches (testing) and measurements were not made to design of products and technology of its production.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.
