About application of anti-dumping measure by means of introduction of anti-dumping duty concerning primary polyethylene of high density coming from the Republic of Uzbekistan and imported on customs area of the Eurasian Economic Union

According to Item 107 of the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries (appendix №8 to the Agreement on the Eurasian Economic Union of May 29, 2014) and based on the report of Department of protection of the domestic market of the Euroasian economic commission the Board of the Eurasian economic commission decided:

1. Apply anti-dumping measure by means of introduction of anti-dumping duty in sizes according to appendix No. 1 to the Eurasian Economic Union of primary polyethylene imported on customs area in firm primary forms with specific weight of 0,94 ^{of g/cm3} and more, the CN FEA EEU coming from the Republic of Uzbekistan and classified by code 3901 20 900 9, having established effective period of this anti-dumping measure of 5 years.

2. Determine that the anti-dumping duty provided by this Decision is not paid concerning this Solution of the goods made by the producers specified in the list according to appendix No. 2, in the presence at the customs applicant of such goods registration date of the declaration on goods of the manufacturer's certificate of origin in form according to appendix No. 3, of the relevant producer signed by the authorized employee and such producer certified by seal and in case of the statement of data on such certificate in the declaration on goods in case of its giving to customs authority specified in Item 1.

3. Approve accepted by producers according to the list provided by appendix No. 2 to this Decision, price obligations.

4. To department of protection of the domestic market of the Eurasian economic commission:

send to the state bodies of state members of the Eurasian Economic Union authorized in the field of customs affairs, specimen signatures of authorized employees and prints of seals of the producers specified in the list provided by appendix No. 2 to this Decision;

exercise control of execution of the price obligations provided by this Decision;

perform monitoring in the market of the Eurasian Economic Union regarding certainty of supply by the companies applicants for reasonable prices of this Solution of goods specified in Item 1;

in case of cancellation of price obligations, the stipulated in Item 3 presents of the Decision or exhaustion of the supply rates specified in the approved price obligations to carry out review of anti-dumping measure in the presence of the bases by results of monitoring.

5. To department of anti-monopoly regulation of the Eurasian economic commission during action of the anti-dumping measure established by this Decision on semi-annual basis to perform monitoring of situation in the market of primary polyethylene in firm primary forms with specific weight 0, ^94g/cm3 and more Eurasian Economic Union and to inform Board of the Eurasian economic commission on its results.

6. In case of identification of the changed circumstances in the market of primary polyethylene in firm primary forms with specific weight of 0,94 ^g/cm3 and more Eurasian Economic Union in case of application of this Decision to provide sales opportunity of Item 110 of the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries (appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014).

7. To provide to the state bodies of state members of the Eurasian Economic Union authorized in the field of customs affairs collection of the anti-dumping duty provided by this Decision, being guided both by code of the CN FEA EEU, and description of goods.

8. This Decision becomes effective after 30 calendar days from the date of its official publication.
