The Cabinet of Ministers of the Kyrgyz Republic and the Government of the Republic of Uzbekistan which further are referred to as with the Parties

being guided by the Contract on eternal friendship between the Kyrgyz Republic and the Republic of Uzbekistan of December 24, 1996,

including development of education by the most important condition of cultural and humanitarian interaction and cooperation of two states,

agreed as follows:

Article 1.

The purpose of this agreement is the construction and equipment of comprehensive schools, everyone on 330 student places, in the villages of Samarkandek of the Batken district and Margun of Leyleksky district of Batken Province (further - Objects) at the expense of means of the Uzbek side and voluntary conveyance of Objects to the Kyrgyz side in property.

Article 2.

Authorized bodies of the states of the Parties on implementation of provisions of this agreement are:

on behalf of the Cabinet of Ministers of the Kyrgyz Republic - the Ministry of Education and Science of the Kyrgyz Republic, the State agency of architecture, construction and housing and communal services under the Cabinet of Ministers of the Kyrgyz Republic, the Office of the plenipotentiary of the President of the Kyrgyz Republic in Batken Province;

on behalf of the Government of the Republic of Uzbekistan - the Ministry of national education of the Republic of Uzbekistan, the Ministry of construction of the Republic of Uzbekistan, Khokimiyat of the Fergana region of the Republic of Uzbekistan.

Article 3.

For the purpose of implementation of this agreement Kyrgyz side:

a) allocates the parcel of land with Ploshchad 3,0 of hectare, at the address: Kyrgyz Republic, Batken Province, Leyleksky district, village of Margun, Ulitsa Mektep No. 16; parcel of land Ploshchad 1,75 of hectare, at the address: The Kyrgyz Republic, Batken Province, the Batken district, the village of Samarkandek, Ulitsa Kelechek No. 6, suitable for construction of facilities and exempted from any obligations according to the legislation of the Kyrgyz Republic;

b) determines asset holders of Objects according to the legislation of the Kyrgyz Republic;

c) carries out preparatory work on release of the territories of building, barrier and providing with sidings, will make connection to engineering communications of city networks and will perform improvement works in the adjacent territories;

d) provides necessary conditions for performance of works on construction and equipment of Objects, including promotes issue in short terms of all necessary allowing documents, to development and approval of the design estimates according to the technical requirements established by the legislation of the Kyrgyz Republic, necessary from the beginning of construction and equipment before signing between authorized bodies of the states of the Parties of the corresponding delivery-acceptance certificates of Objects;

e) will provide the territories for warehousing and placement of construction towns, traffic routes of vehicles and special equipment, places for export import of soil and dump of construction debris for the purpose of performance of works on construction and equipment of Objects;

e) renders assistance to the general contract organization determined by the Uzbek side, and also its subcontract organization having the corresponding permissions / licenses to implementation of construction activities granted by the authorized body of the Republic of Uzbekistan or other foreign state, by recognition of these permissions / licenses operating in the territory of the Kyrgyz Republic without carrying out supplementary procedures of licensing and without issue of the national license by entering of data on it by the licensor into the register and their state registration and their inclusion in the Unified State Register of Legal Entities, branches (representations).

Construction works of the general contract organizations and subcontractors attracted with the Uzbek side will be performed with observance of requirements of the legislation of the Kyrgyz Republic in the field of construction.

Authorized bodies of the Kyrgyz Republic appoint in return the corresponding officials rendering necessary assistance to project and contract organizations of the Republic of Uzbekistan in observance of requirements of the legislation of the Kyrgyz Republic in case of development, adaptation and receipt of the conclusions of the corresponding examination, accomplishment of construction and other works, and also in case of observance of requirements of construction supervision;

g) according to the procedure, stipulated by the legislation the Kyrgyz Republic, exempts the construction materials, the equipment, the equipment imported into the Kyrgyz Republic from the Republic of Uzbekistan and exported from the Kyrgyz Republic to the Republic of Uzbekistan for construction and equipment of Objects from indirect taxes, except for excisable groups of goods, import customs duties and customs duties for making of the actions connected with release of goods, the Uzbek side and its general contract and subcontract organizations from all types of tax and charges or payments connected with construction and voluntary conveyance of Objects;

h) according to the procedure, stipulated by the legislation the Kyrgyz Republic, provides visa support and execution of entrance/exit visas of the Kyrgyz Republic and performs the procedure of registration of personnel - the citizens of the Republic of Uzbekistan participating in construction and equipment of Objects without collection of the state fee, consular and other fees, and also exempts from receipt of allowing documents on labor activity;

i) according to the procedure, stipulated by the legislation the Kyrgyz Republic, ensures safety of the general contract organization determined by the Uzbek side and also its subcontract organization in safety of personnel - the citizens of the Republic of Uzbekistan attracted to construction and equipment of Objects and also will provide to them emergency and emergency medical service for construction and equipment of Objects;

j) renders assistance in delivery necessary for works on construction and equipment of Objects of construction materials, the machinery and equipment to the building site, and after completion of works - in delivery of the equipment, oborudovaniye and unused construction materials to the agreed items of the omission on the Kyrgyz-Uzbek frontier;

k) at the request of the Uzbek side renders assistance concerning attraction for performance of works and rendering services of the organizations and citizens of the Kyrgyz Republic in construction and equipment of Objects.

Article 4.

For the purpose of implementation of this agreement Uzbek side:

a) provides development of the design estimates according to technical requirements, stipulated by the legislation the Kyrgyz Republic, and also its approval of the Kyrgyz side;

b) provides and raised by forces and funds construction of facilities, including import necessary for construction and equipment of Objects of construction materials, the machinery and equipment;
