I.O.'S ORDER OF THE MINISTER OF ECOLOGY, GEOLOGY AND NATURAL RESOURCES OF THE REPUBLIC OF KAZAKHSTAN

About approval of Requirements to separate collection of waste, including to types or groups (set of types) of the waste which are subject to mandatory separate fee taking into account technical, economic and ecological feasibility

According to Item 3 of article 321 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 I ORDER:

1. Approve the enclosed Requirements to separate collection of waste, including to types or groups (set of types) of the waste which is subject to mandatory separate fee taking into account technical, economic and ecological feasibility.

2. To provide to department of state policy in waste management of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Requirements to separate collection of waste, including to types or groups (set of types) of the waste which is subject to mandatory separate fee taking into account technical, economic and ecological feasibility

Chapter 1. General provisions

1. These Requirements to separate collection of waste, including to types or groups (sets of types) of the waste which is subject to mandatory separate fee taking into account technical, economic and ecological feasibility (further - Requirements) are developed according to Item 3 of article 321 of the Ecological Code of the Republic of Kazakhstan (further - the Code).

2. In these Requirements the following terms and determinations are used:

1) container areas - special platforms for accumulating of waste on which containers for collection of municipal solid waste are placed (further - MSW), with availability of sidings for the specialized transport performing transportation of MSW;

2) waste - any substances, materials or objects formed in production process, performance of works, rendering services or in the course of consumption (including the goods which lost the consumer properties) which their owner directly recognizes as waste, or shall direct to removal or recovery owing to requirements of the law either intends to subject or subjects to transactions on removal or recovery;

3) container for separate collection of waste - the specialized Reservoir with the corresponding contrast marking intended for separate collection of separate types of waste, made according to requirements of documents for standardization and which is placed on container areas or in places specially allotted for this purpose;

4) centralized system of collection of waste (further - centralized system) - the system organized by local executive bodies within providing physical persons and legal entities irrespective of the patterns of ownership and type of activity which are living (being) and (or) performing the activities in apartment houses, or separate buildings (constructions) and not having on the property right of container areas and containers, and also having on the property right the container areas and containers located on lands public, services in collection, transportation of MSW;

5) accumulating of waste - the temporary warehousing of waste in specially established places performed in the course of formation of waste or further management by them until their final recovery or removal;

6) separate collection of waste - collection of waste separately by types or groups for the purpose of simplification of further specialized department them;

7) waste management - the transactions performed concerning waste from the moment of their education before final removal;

8) the specialized organizations (companies) - the individual entrepreneurs or legal entities performing activities for collection, sorting and (or) transportation of waste, recovery and (or) destruction of harmless waste in the notifying mode in the field of waste management, or performing activities for conversion, neutralization, utilization and (or) destruction of dangerous wastes with receipt of the license for performance of works and rendering services in the field of environmental protection;

9) large-size waste - the consumer wastes and economic activity (household appliances, furniture and another) which lost the consumer properties and by the sizes the transportations excluding opportunity on specialized vehicles.

3. Owners of waste make collection and accumulating of waste on container areas or in rooms specially allotted for this purpose.

4. Transfer of waste to the specialized organizations (companies) performing transactions on collection, recovery or waste disposal means at the same time transition to such persons of law of property to waste, including at the time of the room of waste in the containers placed in the territory of container areas or to the established places of collection of waste.

5. The waste subjected to separate collection at all further stages of waste management does not mix up.
