Regulations on Department of preserving biodiversity and especially protected natural territories under the Ministry of natural resources, ecology and technical supervision of the Kyrgyz Republic

1. General provisions

1. This Provision determines legal and organizational basis of activities of Department of preserving biodiversity and especially protected natural territories under the Ministry of natural resources, ecology and technical supervision of the Kyrgyz Republic (further - Department), its purposes, task, function and power.

2. The department is the subordinated division of the Ministry of natural resources, ecology and technical supervision of the Kyrgyz Republic (further - the Ministry) performing activities in the sphere of preserving biodiversity, development of network of especially protected natural territories, scientific and ecological tourism.

3. The department is legal successor of Department of preserving biodiversity and especially protected natural territories under the State committee on ecology and climate of the Kyrgyz Republic.

4. The department in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, acts of the President of the Kyrgyz Republic, Jogorku Kenesh of the Kyrgyz Republic, the Cabinet of Ministers of the Kyrgyz Republic, the international treaties which became effective according to the legislation of the Kyrgyz Republic, orders and orders of the Ministry, and also this Provision.

3. Tasks of Department

12. The main objectives of Department are:

- development of offers and realization of state policy in the sphere of preserving biodiversity and steady functioning and development of OOPT network;

- the organization and implementation of scientific research in the sphere of assessment of condition of resources of biodiversity in OOPT network, their analysis and forecasting of changes;

- the organization and studying of all natural objects and complexes, natural processes and the phenomena in OOPT;

- introduction of offers on development and implementation of national and international projects and programs, contracts and agreements in the sphere of preserving biodiversity and development of OOPT network;

- ensuring biological and landscape diversity, maintenance of ecological equilibrium in the OOPT system;

- increase in degree (level) in knowledge of state bodies, local public administrations and local government bodies, the population and other interested persons about condition of biodiversity and about activities of subjects of OOPT;

- the organization and ensuring protection of all natural complex and the objects of animal and flora which are on OOPT;

- the organization of collection and the analysis of data on condition of natural complexes and objects, about observance of requirements of the nature protection legislation of OOPT, and also about results of activities of the national natural parks and state natural parks;

- the organization of work on creation new and to expansion of the existing OOPT and their functional zones;

- ensuring preserving biodiversity by ecological, economic and scientific cases of development of OOPT network.

4. Functions of Department

13. The department according to the assigned tasks performs the following functions in OOPT network:

1) in the sphere of realization of industry policy:

- makes in accordance with the established procedure in the Ministry the offers and projects of regulatory legal acts, other materials concerning:

establishments of legal relations in the sphere of ensuring preserving biodiversity;

procedure for education, zoning and delimitation of OOPT, their use, change of categories and liquidation;

developments of OOPT network and natural objects;

the state monitoring, observance of the set mode in OOPT network;

maintaining the state inventory of OOPT;

procedure for maintaining passport of OOPT and chronicle of the nature;

procedure for stay of citizens in the territories of OOPT;

natural and reserved case;

creation and mode of functioning of zones of preserving objects of animal and flora, reproduction sites, network of ecological corridors;

conditions, terms and procedure for accounting, inventory and monitoring of objects of biodiversity;

investment attraction, grant means and use of the best practices on functioning of OOPT network in case of coordination of the Ministry by the relevant authorized structural division;

- within the competence initiates development and enables the realization of state policy, national and international programs, projects, agreements and agreements in the sphere of preserving biodiversity, development and functioning of OOPT network, scientific and ecological tourism;

- organizes activities of subjects of OOPT;

- promotes maintaining on OOPT of works on monitoring of forest resources, to accounting of forest fund, afforestation, forming and use of data for the forest inventory;

- performs promotion and dissemination of knowledge about the nature, will organize and carries out competitions, the share "March of Parks", exhibitions, conferences, seminars on preserving resources of biodiversity;

- provides explanation of provisions of the corresponding technical regulations for representatives of business, the companies, the organizations;

- within the competence participates in programs of cooperation with the foreign and international organizations in the sphere of preserving resources of biodiversity, studying of their condition, collection and exchange in accordance with the established procedure of ecological information, representation of the Kyrgyz Republic at the international level in case of coordination of the Ministry by the relevant authorized structural division;

- performs the conclusion of memorandums, agreements, regulations, instructions about interaction with state bodies and other organizations for assistance to the solution of questions of the competence and realization of adjacent functions;

16. The department according to the assigned functions has the right:

- request and receive information necessary for accomplishment of the functions from state bodies, other organizations and the organizations;

- render assistance in studying, preserving and use of monuments of archeology in the territories which are under authority of Department and subjects of OOPT;

- give advisory and methodical help to the legal entities performing activities in the sphere of preserving biodiversity, and also other types of activity connected with impact on objects of biodiversity and the circle of their dwelling / growth;
