About approval of the Regulations on voluntary forming of territorial communities

According to the paragraph to third "About bases of national resistance" the Cabinet of Ministers of Ukraine decides parts two of article 8 of the Law of Ukraine:

1. Approve Regulations on voluntary forming of territorial communities which are applied.

2. To the ministries and other central executive bodies to bring the regulatory legal acts into accord with this resolution.

Regulations on voluntary forming of territorial communities

1. This Provision determines procedure for education and activities of voluntary forming of territorial communities (further - voluntary forming), acquisitions and the terminations of membership in voluntary forming.

In this Provision the term "voluntary forming of territorial communities" is used in the value given in article 1 of the Law of Ukraine "About bases of national resistance" (further - the Law), the term "territorial community" - in the value given in article 1 of the Law of Ukraine "About local self-government in Ukraine".

2. Within the tasks of territorial defense determined by the Law, voluntary forming can perform such activities:

1) timely to react and take necessary measures for defense of the territory and protection of the population in certain area until expansion within such territory of group of troops (forces) or group of the integrated forces intended for conducting military (fighting) operations on repulse of the armed aggression against Ukraine;

2) to take part in strengthening of protection and protection of frontier according to the procedure determined by the Law of Ukraine "About participation of citizens in protection of public order and frontier";

3) to take part in protection of the population, the territories, the environment and property against emergency situations, mitigation of consequences of conducting military (fighting) operations;

4) to participate in training of citizens of Ukraine for national resistance;

5) to take part in providing conditions for safe functioning of public authorities, other state bodies, local government bodies and bodies of military management;

6) to take part in protection and defense of important objects and communications, other crucial infrastructure facilities determined by the Cabinet of Ministers of Ukraine, and objects of the increased danger, violation of functioning and which inactivation pose threat for activity of the population;

7) to take part in providing conditions for strategic (operational) expansion of troops (forces) or their regrouping;

8) to take part in implementation of measures of rather temporary prohibition or traffic restriction of vehicles and pedestrians near and within zones/areas of emergency situations and/or conducting military (fighting) operations together with National police;

9) to participate in providing measures of public safety and procedure in settlements together with National police;

10) to participate in implementation and implementation of actions of legal regime of warlike situation in case of its introduction in all territory of Ukraine or in its certain areas;

11) to take part in fight against diversionary and prospecting forces, other paramilitary groups of aggressor (opponent) and the militarized or paramilitary groups which are not provided by the laws of Ukraine;

12) to participate in the information actions directed to increase in level of defense capability of the state and counteraction to information transactions of aggressor (opponent);

13) to cooperate with local government bodies and military units Sil of territorial defense of Armed Forces, to collect and analyze information on safety hazards of territorial community and scenarios of their control;

14) in cooperation with local government bodies to consider, equip and protect places of the shelter of the population;

15) to perform getting, collection and generalization of information which influences accomplishment of tasks of territorial defense within the territory of territorial community;

16) to promote implementation of measures for counteraction to information transactions of aggressor (opponent) in the territory of territorial community;

17) to organize training of members of voluntary forming for the purpose of effective implementation of the tasks.

3. The commander of voluntary forming is responsible for activities of voluntary forming. The commander determines tasks to members of voluntary forming taking into account their opportunities and, if necessary, structure of voluntary forming.

Activities of voluntary forming are performed under direct management and control of the commander of military unit by Sil of territorial defense of Armed Forces by the territorial principle.

Preparation of voluntary forming for accomplishment of tasks of territorial defense is performed according to the Procedure for the organization, providing and carrying out preparation of voluntary forming of territorial communities for accomplishment of tasks of territorial defense approved by the resolution of the Cabinet of Ministers of Ukraine of December 29, 2021 No. 1447.

4. Members of voluntary forming in case of accomplishment of tasks of territorial defense have the right to use individual hunting weapon, small arms, other types of arms and ammunition to them according to Procedure for application by members of voluntary forming of territorial communities of individual hunting weapon, small arms, other types of arms and ammunition to them during accomplishment of tasks of territorial defense approved by the resolution of the Cabinet of Ministers of Ukraine of December 29, 2021 No. 1448 (The Official Bulletin of Ukraine, 2022, No. 10, of the Art. 516).

5. Providing with material means and financing of activities of voluntary forming are performed for the account and within means of the Government budget of Ukraine, local budgets, and also from other sources which are not forbidden by the legislation.

6. Membership in voluntary forming does not exempt from obligation of passing of compulsory military service, military service during mobilization, for the special period, military service of faces of officers, military service of persons from among reservists during the special period.

7. During mobilization volunteers of territorial defense who are for health reasons suitable for military service in wartime and have military specialty, if necessary are called for completing of military units by Sil of territorial defense of Armed Forces and other components of forces of defense by the territorial principle.
