About craft activity in the Kyrgyz Republic

Article 1. Subject of regulation of this Law

1. This Law governs the relations arising when implementing craft activity in the Kyrgyz Republic.

2. The legal basis of regulation of the relations in the field of craft activity are the Constitution of the Kyrgyz Republic, regulatory legal acts regulating activities of subjects of small and medium business, and other regulatory legal acts.

Article 2. Main objectives of this Law

The main objectives of this Law are:

1) revival, protection, development and promotion of historical and ancient traditions of art of workmanship, national culture and heritage;

2) creating favorable conditions for workmanship development;

3) development of production capabilities of workmanship;

4) training of specialists in the sphere of workmanship;

5) assistance of new workplaces to the organization in the sphere of workmanship.

Article 3. Basic concepts

For the purposes of this Law the following basic concepts are used:

1) craft activity (workmanship) - type of professional activity on production of goods, works, rendering services mainly consumer appointment in small lots, shtuchno, including by individual orders, with use of special knowledge, abilities, skills, special technologies, traditions, secrets.

Do not treat craft activity mass, large-lot and serial production;

2) subjects of craft activity - the physical persons and legal entities performing craft activity;

3) the handicraftsman - the physical person having knowledge, skills, skill and (or) professional specialization, occupied with workmanship;

4) the craft organization - the organization uniting master handicraftsmen of one or several similar professions on occupation characteristics.

Legal form, competence and procedure for forming of governing bodies, sources of formation of property, the right and obligation of founders (members) and other provisions concerning activities of the craft organizations are determined by constituent documents according to the legislation of the Kyrgyz Republic;

5) the master - the handicraftsman who reached great skills in the case, received the certificate on assignment to it qualification which is attracting to production of goods and performance of works of pupils, having the right to personal brand, being the carrier of traditions of any craft. The certificate confirming skill level of the master is issued by the independent accredited organization according to the procedure, established by the Cabinet of Ministers of the Kyrgyz Republic.

Article 4. State support of craft activity

1. The state support of workmanship is performed according to the procedure established by the legislation of the Kyrgyz Republic.

2. The central and local authorities of the government according to the procedure, established by the legislation of the Kyrgyz Republic, support the initiatives of subjects of workmanship by creation of favorable working conditions, the organizations of exhibitions of sales of goods and the made products, providing with raw materials and implementation of other measures for their support.

3. Enter competence of the Cabinet of Ministers of the Kyrgyz Republic of the sphere of craft activity:

1) conducting state policy;

2) approval of state programs on development of craft activity;

3) determination of authorized state body;

4) approval of regulations on procedure for creation and maintaining register of handicraftsmen;

5) approval of the list of types of craft activity;

6) provision of tax benefits according to the procedure, established by the tax legislation of the Kyrgyz Republic;

7) establishment of the lowered charge rates of lease of the rooms which are in state-owned property;

8) provision of property support for implementation of productive and educational activity according to requirements of the legislation of the Kyrgyz Republic;

9) provision of the preferential loan for startups for implementation of craft activity.

Article 5. Powers of authorized state body in the sphere of workmanship

In the sphere of workmanship are included into power of authorized state body:

1) realization of state policy in the sphere of workmanship;

2) development and representation of the Kyrgyz Republic of drafts of state programs to the Cabinet of Ministers on workmanship development;

3) adjustment of cooperation and partnership with the appropriate internal and external subjects in the sphere of workmanship;

4) coordination of activities of subjects of workmanship;

5) holding of conferences, the trade fairs and tenders connected with workmanship.

Article 6. Register of handicraftsmen

The register of handicraftsmen is created:

1) for storage and updating of information on subjects of workmanship and providing quick access to it;

2) for decision making about provision to subjects of workmanship of privileges and preferences;

3) for the solution of analytical tasks by determination of prospects and tendencies of development of craft activity;

4) for holding selective and full-scale polls of subjects of workmanship.

Article 7. Rights and obligations of subjects of workmanship

1. Subjects of workmanship have the right:

1) to make craft products and to dispose of it;

2) independently to attract the pupil probationer to production process of craft products and accomplishment of other corresponding works;

3) individually or in group form to train the pupil probationer within the requirements determined by the legislation of the Kyrgyz Republic;

4) to determine the cost of products prepared, made or independently created by it;

5) to use privileges, stipulated by the legislation the Kyrgyz Republic;

6) to participate in actions of various level concerning workmanship;

7) to create associations according to the procedure, established by the legislation of the Kyrgyz Republic;

8) to make offers on development of the sphere of workmanship to authorized state body in the sphere of workmanship.

2. Subjects of workmanship shall:

1) to provide the quality of production of goods and products meeting the requirements established by the legislation of the Kyrgyz Republic;

2) to control process of implementation of activities of the pupil probationer;

3) to carry out other obligations, stipulated by the legislation the Kyrgyz Republic.

Article 8. Master

1. The master has the right:

To involve 1) in production of goods, performance of works and rendering services of pupils;

To train 2) in the craft pupils;

3) to make the work products corresponding to the direction of the performed craft activity and also to realize them independently or otherwise;

4) to determine the prices of the made goods, works and services;

5) to use all privileges established for small business entities.
