About measures for transformation of system of road industry

For the purpose of effective realization of the tasks set for the Ministry of Transport and Communications of the Kyrgyz Republic, increase in responsibility for achievement of results according to the Presidential decree of the Kyrgyz Republic "About structure and structure of the Cabinet of Ministers of the Kyrgyz Republic and structure of Administration of the President of the Kyrgyz Republic" of October 12, 2021 No. 425, Articles 87, 92 Civil codes of the Kyrgyz Republic, articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Create:

1) Road fund under the Ministry of Transport and Communications of the Kyrgyz Republic;

2) the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic by accession of the following state companies to it and organizations:

- road and operational organizations No. 1 - No. 28, No. 30 - No. 48, No. 50 - No. 52, No. 954 - No. 960 of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- the state company "State Directorate of the Highway Bishkek-Osh" of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- "Management of Osh-Sarytash-Irkeshtam Highway" organization of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- "Management of Bishkek-Naryn-Torugart Highway" organization of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- "Management of Jalal-Abad-Balykchy Highway" organization of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- "Management of Osh-Batken-Isfana Highway" organization of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- state company "Jalal-Abad Construction Management";

- state company "Public Road and Repair Construction Administration".

2. Approve:

1) the Charter of the state company "Kyrgyz of Avtobeketa" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 1;

2) the Charter of the state company "Design and survey institute "Kyrgyzdortransproyekt" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 2;

3) Regulations on public institution "Production and innovative center" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 3;

4) Regulations on Road fund under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 4;

5) the Charter of the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 5.

2-1. Approve the sizes of official pay rates of employees of Road fund under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 8.

3. Determine that the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic is legal successor:

- road and operational organizations No. 1 - No. 28, No. 30 - No. 48, No. 50 - No. 52, No. 954 - No. 960 of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

- the state company "State Directorate of the Highway Bishkek-Osh" of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic;

5. Make changes to some decisions of the Government of the Kyrgyz Republic according to appendix 7.

6. To the Ministry of Transport and Communications of the Kyrgyz Republic:

- approve transfer acts of the reorganized legal entities specified in this resolution;

- organize accomplishment of the corresponding procedures for reception-transmission of the available established posts, the parcels of land, financial and material resources;

- take the measures for employment of the released established posts which are not requiring additional costs from the republican budget in the procedure established by the labor law;

- carry out in accordance with the established procedure state registration and re-registration of the legal entities determined by this resolution;

- in a month to bring the decisions into accord with this resolution.

6-1. Determine that till May 1, 2022 financing of the actions connected with designing, content, repair, reconstruction, construction and development of highways public is made through Department of road economy under the Ministry of Transport and Communications of the Kyrgyz Republic.

7. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About transformation of the state companies of Department of road economy under the Ministry of Transport and Roads of the Kyrgyz Republic" of December 21, 2016 No. 692;

2) Item 3 and appendix to the order of the Government of the Kyrgyz Republic "About creation of the state company "Kyrgyz of Avtobeketa" under the Ministry of Transport and Roads of the Kyrgyz Republic" of August 18, 2017 No. 509;

3) Item 3 and appendix to the order of the Government of the Kyrgyz Republic "About some questions of the Ministry of Transport and Roads of the Kyrgyz Republic" of August 24, 2017 No. 539;

4) the order of the Government of the Kyrgyz Republic "About approval of the Charter of the state company "Design and Survey Institute "Kyrgyzdortransproyekt" under the Ministry of Transport and Roads of the Kyrgyz Republic" of January 30, 2018 No. 63;

5) Item 9 of appendix 9 to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of the Ministry of digital development of the Kyrgyz Republic" of June 1, 2021 No. 17.

8. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

1. This Charter regulates activities of the state company "Kyrgyz of Avtobeketa" under the Ministry of Transport and Communications of the Kyrgyz Republic (further - the Company).
