About approval of the Method of calculation of utilization payment

According to Item 5 of article 386 of the Ecological code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Method of calculation of utilization payment.

2. Recognize invalid some regulatory legal acts according to appendix to this order.

3. To provide to department of state policy of waste management of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

Method of calculation of utilization payment

1. This Method of calculation of utilization payment (further - the Technique) is developed according to Item 5 of article 386 of the Ecological code of the Republic of Kazakhstan (further - the Ecological code) and is intended for calculation of the amount of utilization payment for implementation of expanded obligations by producers (importers) according to the subitem 2) of Item 2 of article 386 of the Ecological code.

2. Calculation of utilization payment (Sproduktion) concerning the made (imported) products (goods) on which (which) expanded obligations of producers (importers), and its packagings extend it is calculated by the following formula:

Sproduktion – utilization payment;

m – the mass of the made (imported) products (goods) (in tons);

Smrp – the amount of one monthly settlement indicator;

k – coefficient for calculation of utilization payment for products (goods) to which producers (importers) expanded obligations of producers (importers) extend, determined according to appendix 1 to this Technique.

3. Calculation of utilization payment (Skpp) for the organization of collection, transportation, conversion, neutralization, use and (or) waste recycling of cable and conduction products, is calculated by the following formula:

N – the cost of products (goods) specified in the invoice (invoice), excluding tax value added.

4. According to the Rules of implementation of expanded obligations of producers (importers) approved by the Government of the Republic of Kazakhstan according to Item 7 of article 386 of the Ecological code, producers and importers of products (goods) in packaging for calculation of the amount of utilization payment use information from the reference book of average indicators of mass of units of production (goods) and (or) packagings of products (goods) provided in the list of products (goods) to which expanded obligations of producers (importers), according to appendix 2 to this Technique extend.

The utilization payment concerning vehicles and self-propelled agricultural machinery is paid to the Operator once for each vehicle or self-propelled agricultural machinery, according to base rate and coefficients of utilization payment concerning vehicles and self-propelled agricultural machinery according to appendix 4 to this Technique (further – Appendix 4).

7. The base rate of utilization payment and coefficients applied to base rate of utilization payment concerning vehicles and self-propelled agricultural machinery and also their components are represented by authorized body in the field of the state support of industrial activities.

8. Calculation of utilization payment concerning vehicles and self-propelled agricultural machinery is made by each type and category of vehicles and self-propelled agricultural machinery according to Appendix 4 as follows:
