This Law determines organizational, legal and economic basis of activities of business entities in poultry-farming industry and is aimed at the development of industry and ensuring the consumable market of the country.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

- poultry-farming industry - the agricultural industry providing production of fowl, food, hatchable eggs and other types of products;

- business entity in poultry-farming industry the business entity who is engaged in production of fowl, food and hatchable eggs, removal of chickens, and also storage and sales of products of industry;

- birds - group of the vertebral warm-blooded oviparous feathery animals constituting separate class of fauna;

- agricultural birds - all bird species divorced for the purpose of production of meat, dining rooms and hatchable eggs and other types of products;

- hybrid birds are the birds resulting from cross-breeding of the birds having features and hereditary or maternal signs;

- breed of bird - the intraspecific complex and numerous groups of one type of agricultural bird having similar qualities of performance, structure and appearance;

- cross - complex of lines and hybrids of the agricultural birds appearing within certain procedure for crossing, the having high productivity and resistance to life;

- hatchable egg - the inseminated egg used for removal of chickens;

- products of poultry-farming industry - the main products - fowl, eggs, young growth and additional products - waste from face of bird, down, feathers and fertilizer.

Article 2. Legislation of the Republic of Tajikistan on poultry farming

The legislation of the Republic of Tajikistan on poultry farming is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 3. The principles of activities in poultry-farming industry

Activities in poultry-farming industry are based on the following principles:

- formirovannost of steady system of providing population with products of poultry-farming industry;

- priority of the rights of consumers;

- efficiency and free competition in production and sale of products of poultry-farming industry;

- transparency of accounting of results of activities and reporting;

- use of the modern production technology of products of poultry-farming industry;

- predictability and zaplanirovannost of production and sale of products of poultry-farming industry;

- security of observance of standards and technical regulations of safety of the made products.

Article 4. Business entities of poultry-farming industry

1. Treat business entities of poultry-farming industry:

1) the breeding poultry-farming company (economy) which is engaged in reproduction and enhancement of genetic and productive qualities of separate breeds and crosses of birds;

2) the plemptitsereproduktor (economy) of the I procedure specialized on production of parent forms of birds of high performance and with other distinctive factors;

3) the plemptitsereproduktor (economy) of the II procedure specialized on production of hatchable eggs and cultivation of the hybrid birds received as a result of crossing of two and more genetically differing parent forms;

4) poultry-farming company (economy);

5) poultry farm (component of agricultural industry, Dehkan (farmer) economy) which is engaged in cultivation of agricultural bird for the purpose of production of fowl and table eggs.

2. Business entities undergo the state registration according to the legislation of the Republic of Tajikistan for implementation of activities for production and sales of products of poultry-farming industry.

3. Creation and determination of form of activities of business entities of poultry-farming industry are performed according to the procedure, established by the legislation of the Republic of Tajikistan.

4. The business entity can perform at the same time different activities of poultry-farming industry with observance of the corresponding ratio.

5. The physical persons who are not individual entrepreneurs can be engaged in poultry farming for satisfaction of the personal needs.

Chapter 2. Regulation and state support of poultry-farming industry

Article 5. Methods of state regulation of poultry-farming industry

State regulation of poultry-farming industry is performed by the following methods:

- acceptance of regulatory legal acts;

- state production control and sales of products of poultry-farming industry;

- state support of business entities of industry, including development financing of industry;

- establishment of anti-monopoly requirements to turnover of products of poultry-farming industry.

Article 6. Directions of the state support of poultry-farming industry

The state support of poultry-farming industry is performed in the following directions:

- investment attraction for creation of the companies of poultry-farming industry, production and sale of products of industry;

- ensuring access to the equipment and modern technology of cultivation of all types of agricultural birds;

- implementation of funding mechanism for scientific research of scientific institutions in determination of breeds, creation of new crosses of birds, enhancement of useful qualities of the existing breeds and strengthening of base of production of bird's forage at the expense of internal sources;

- development of infrastructure of the market of products of poultry-farming industry and providing information on production volume and its realization;

- other forms of support which are not prohibited by the legislation of the Republic of Tajikistan.

Article 7. Competence of the Government of the Republic of Tajikistan of poultry-farming industry

To competence of the Government of the Republic of Tajikistan of poultry-farming industry it is carried:

- ensuring realization of state policy in poultry-farming industry;

- acceptance of regulatory legal acts on regulation of poultry-farming industry; establishment of forms of the state support of poultry-farming industry;

- determination of the main directions of international cooperation in poultry-farming industry;

- determination of authorized state body in poultry-farming industry;

- implementation of other powers, stipulated by the legislation Republic of Tajikistan.
