Questions of use of aerodrome environs

According to part three of article 69 of the Air code of Ukraine, subitems 3 and 4 of Item 11 of the Section II "Final and transitional provisions" of the Law of Ukraine of October 17, 2019 "About modification of some legal acts of Ukraine concerning enhancement of procedure for provision of administrative services in the field of construction and creation of Single state electronic system in the field of construction" the Cabinet of Ministers of Ukraine decides No. 199-IX:

1. Approve enclosed:

Procedure for determination in town-planning conditions and limiting restrictions of height and planning restrictions of building of the parcels of land on aerodrome environs and information exchange for this purpose;

Procedure for establishment of restrictions of use of aerodrome environs.

2. Bring in resolutions of the Cabinet of Ministers of Ukraine of December 6, 2017 No. 954 "About approval of the Regulations on use of airspace of Ukraine" (The Official Bulletin of Ukraine, 2017, No. 101, the Art. 3118) and of June 23, 2021 No. 681 "Some questions of ensuring functioning of Single state electronic system in the field of construction" (The Official Bulletin of Ukraine, 2021, No. 55, the Art. 3401) changes which are applied.

3. Recommend to providers of aeronautical servicing and operators of airfields (helidromes) to provide till April 22, 2022 connection to electronic office of the user of provider of aeronautical servicing and the operator of airfield (helidrome) in Single state electronic system in the field of construction.

4. To provide to the ministry of development of communities and territories:

1) till February 18, 2022 development of electronic office of the user of the Public air service and Ministry of Defence in Single state electronic system in the field of construction;

2) till March 25, 2022 development of electronic office of the user of provider of aeronautical servicing and the operator of airfields (helidromes) in Single state electronic system in the field of construction.

5. Provide to the public air service:

1) till February 25, 2022 connection to electronic office of the user of the Public air service in Single state electronic system in the field of construction;

2) till March 25, 2022 entering into Single state electronic system in the field of construction of data on airfields (helidromes) of civil aviation, except information containing the state secret with indication of: names of airfield (helidrome), the operator of airfield (verodrom), the size of aerodrome environs of airfield (helidrome) in kilometers, excesses of airfield (helidrome) (exceeding of the highest point of the landing area above sea level) in the Baltic system of heights, coordinates of checkpoint of airfield (helidrome).

6. Provide to the Ministry of Defence:

1) till February 25, 2022 connection to electronic office of the user of the Ministry of Defence in Single state electronic system in the field of construction;

2) till March 25, 2022 entering into Single state electronic system in the field of construction of data on airfields (helidromes) of the state aircraft, except information containing the state secret with indication of: names of airfield (helidrome), the operator of airfield (helidrome), the size of aerodrome environs of airfield (helidrome) in kilometers, excesses of airfield (helidrome) (exceeding of the highest point of the landing area above sea level) in the Baltic system of heights, coordinates of checkpoint of airfield (helidrome).

7. Prior to functioning and connection of users of office of provider of aeronautical servicing and the operator of airfields (helidromes) in Single state electronic system in the field of construction interaction between users is performed in paper form, and the documents (estimates) received in paper form are subject to loading in Single state electronic system in the field of construction during creation by the Public air service of the conclusion about the extreme height of objects on aerodrome environs.
