About modification of some legal acts of Ukraine for enhancement of management system health sector and ensuring medical attendance of the population

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Economic code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 18-22, 144):

Part the ninth Article 73 to state 1) in the following edition:

"9. The state unitary enterprises are effective as the state commercial enterprises, the state non-commercial enterprises or the state companies";

To add 2) with Articles 75-1 and 75-2 of the following content:

"Article 75-1. State non-commercial enterprise

1. The state non-commercial enterprise is subject of the non-commercial economic activity directed to achievement of social results which is formed in the field of health care social and/or humanitarian spheres without the purpose of profit earning and acts on the basis of the Charter.

2. The property of the state non-commercial enterprise is assigned to it on the right of operational management.

3. The public authority within which scope of management the state non-commercial enterprise falls does not bear responsibility according to its obligations, except the cases provided by this Code and other laws.

Article 75-2. Features of economic activity of the state non-commercial enterprises

1. The state non-commercial enterprise shall accept and execute the state orders finished in the procedure established by the legislation, consider them during the forming of the production program, determination of perspectives of the economic and social development and the choice of partners, and also to constitute and carry out annual and with quarterly breakdown the financial plan the next year.

The state non-commercial enterprise performs the activities according to:

the production tasks determined by body within which management scope it falls;

independently established tasks according to the signed agreements on provision of the corresponding services;

state orders.
