About introduction of temporary ban on export of separate types of nitrogen fertilizers from the Russian Federation out of limits of customs area of the Eurasian Economic Union
According to article 47 of the Agreement on the Eurasian Economic Union of May 29, 2014, with appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 1 of part 2 of article 21 of the Federal law "About Bases of State Regulation of Foreign Trade Activity" and for the purpose of ensuring food security the Government of the Russian Federation decides:
1. Establish from February 2 to May 1 inclusive temporary ban on export from the Russian Federation out of limits of customs area of the Eurasian Economic Union of separate types of nitrogen fertilizers (codes 3102 30 100 0 and 3102 30 900 0 CN FEA EEU) (further respectively - temporary ban, fertilizers).
2. Determine that the temporary ban also extends to the fertilizers declared and issued according to the customs procedures allowing export of fertilizers from customs area of the Eurasian Economic Union till February 2, 2022, except for fertilizers concerning which till February 2, 2022 the Ministry of Industry and Trade of the Russian Federation grants licenses according to the subitem "b" of Item 3 of the order of the Government of the Russian Federation of November 3, 2021 No. 1910 "About introduction of temporary quantitative restriction on export of separate types of fertilizers" and permission of customs authority to loading of goods to the vessel decreasing from customs area of the Eurasian Economic Union is issued.
3. The temporary ban does not extend:
on the fertilizers which are exported from the territory of the Russian Federation within the international transit carriages which are beginning and coming to an end outside the territory of the Russian Federation and also on the fertilizers occurring about the territories of the Russian Federation moved between parts of the territory of the Russian Federation through the territories of foreign states;
on the fertilizers which are taken out from the territory of the Russian Federation to the Donetsk People's Republic, the Luhansk People's Republic, the Republic of Abkhazia and the Republic South Ossetia.
4. Provide to the Ministry of Industry and Trade of the Russian Federation suspension of action for the period from February 2 to May 1, 2022 inclusive of licenses for export of the fertilizers issued according to the subitem "b" of Item 3 of the order of the Government of the Russian Federation of November 3, 2021 to No. 1910 "About introduction of temporary quantitative restriction on export of separate types of fertilizers".
5. To the Ministry of Economic Development of the Russian Federation in accordance with the established procedure:
notify the Eurasian economic commission on introduction of temporary ban;
submit for consideration of the Eurasian economic commission the offer on introduction of temporary ban on export of fertilizers from customs area of the Eurasian Economic Union.
6. This resolution becomes effective since February 2, 2022.
