About approval of Rules of the conclusion of agreements of services of the state educational order by means of the web portal of public procurements

1. Approve the enclosed Rules of the conclusion of agreements of services of the state educational order by means of the web portal of public procurements.

2. To provide to department of the higher and postgraduate education of the Ministry of Education and Science of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Education and Science of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication and extends to the legal relationship which arose since January 1, 2022.

Rules of the conclusion of agreements of services of the state educational order by means of the web portal of public procurements

Chapter 1. General provisions

1. These rules of the conclusion of agreements of services of the state educational order by means of the web portal of public procurements (further – Rules), are developed according to the subitem 3) of Item 3 of article 2 of the Law of the Republic of Kazakhstan "About education" (further – the Law) and establish procedure for the conclusion of agreements of services of the state educational order by means of the web portal of the public procurements providing rendering the services connected with the state educational order.

2. In Rules the following concepts are used:

1) financial year – the period of time which is beginning on January 1 and coming to an end on December 31 calendar year during which budget implementation is performed;

2) the agreement of services of the state educational order (further – the agreement) – the civil agreement signed by means of the web portal of public procurements between the customer and the supplier, certified by digital signatures including the agreement of accession which conditions are determined by the customer in standard forms and can be accepted by suppliers precisely by accession to the offered agreement in general;

3) the web portal of public procurements – the information system of state body providing single point of access to electronic services of public procurements;

4) the participant of the web portal of public procurements (further – the participant) – the customer, the supplier who were registered on the web portal of public procurements;

5) the user of the web portal of public procurements (further – the user) – the official of the participant or the representative of the participant;

6) the single operator in the field of public procurements – the legal entity determined by authorized body in the field of public procurements, the single owner of shares (shares in the authorized capital) which is the state;

7) the supplier – the physical person performing business activity, the legal entity, the temporary consolidation legal entities (consortium) which are rendering the services connected with the state educational order, acting as the customer's partner in the agreement of services of the state educational order signed with it;

8) customers – state bodies, public institutions, and also the operator of authorized body in the field of education.

Other concepts and terms used in these rules are applied according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for the conclusion of agreements by means of the web portal of public procurements

3. For work on the web portal of public procurements users make set of the following actions:

1) establish the necessary firmware for possibility of use of certificates (the opened and closed key) of the digital signature;

2) receive certificates (the opened and closed key) of the digital signature in National certification center of the Republic of Kazakhstan;

3) registration on the web portal of public procurements undergo procedures.

4. The certificates of the digital signature published for physical persons and legal entities by National certification center of the Republic of Kazakhstan act on the web portal of public procurements.

4-1. The service in use (access) of the web portal of public procurements within agreements of services of the state educational order to potential suppliers appears the single operator in the field of public procurements on paid basis according to the rates provided for public procurements.

5. The submitted documents and data which are connected with the conclusion and execution of agreements by means of the web portal of public procurements are placed the user in the form of electronic documents or electronic copies of documents and are signed by the digital signature of person having the right to act on behalf of the corresponding user.

6. Time of creation, obtaining and sending all electronic documents and electronic copies of documents on the web portal of public procurements is fixed on time of the automated integrated information system "Electronic Public Procurements".

7. In case of exceeding of the size of the files loaded into System or archives of files of 20 megabytes they need to be loaded into system parts, the size of each of which does not exceed 20 megabytes.

8. The procedure for the conclusion of agreements by means of the web portal of public procurements provides accomplishment of the following consecutive events:

1) registration of participants on the web portal of public procurements (if they are not registered);

2) development and approval by the decision of the first head of the customer or other representative it persons of the plan of the conclusion of contracts for the corresponding financial year in form according to appendix 1 to these rules and placement it on the web portal of public procurements;
