Chapter 1. General provisions

Article 1. Main terms and their determinations

In this Law the following main terms and their determinations are applied:

population census - systematic continuous state statistical observation when which carrying out collection of personal data for the established date for the purpose of forming and distribution of the total characterizing demographic and economic and social situation of the population of the Republic of Belarus is performed;

personal data - primary statistical data about the specific respondent which collection is performed when carrying out population census;

the depersonalized personal data - personal data from which the data allowing to identify the specific respondent are excluded;

total - the official statistical information created by processing of personal data;

the program of population census - the list of questions on which collection of personal data is performed;

census personnel - the full age citizens of the Republic of Belarus involved in preparation and carrying out population census and who underwent special training;

census documentation - set of documents of the established sample, filled during preparation and carrying out population census;

the schedule - the form of the state statistical observation intended for record of personal data on the questions of the program of population census specified in it;

method of carrying out population census - method of collection of personal data;

date of population census - the specific moment (year, month, day and hour) as of which collection of personal data is performed;

the term of carrying out population census - period of time during which collection of personal data is performed;

household - group of persons which jointly live in premises provide themselves to all necessary for life, conduct general economy, fully or partially uniting and spending the means, or one person living independently and providing themselves to all necessary for life.

Article 2. Legislation of the Republic of Belarus on population census

The legislation of the Republic of Belarus on population census is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation of the Republic of Belarus, and also international treaties of the Republic of Belarus.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Purpose of carrying out population census

The purpose of carrying out population census is receipt of information on the population of the Republic of Belarus necessary for development of the state forecasts and programs of social and economic development of the Republic of Belarus, the current calculations and forecasting of number and structure of the population, studying of placement and use of manpower and implementation of scientific research.

Article 4. Basic principles of carrying out population census

The basic principles of carrying out population census are:

scientific justification;

frequency;

generality and contemporaneity;

confidentiality of personal data;

availability and openness of total;

unity of the program of population census, and also methods of its carrying out and processing of personal data for all territory of the Republic of Belarus.

Chapter 2. Subjects of population census, their basic rights and obligations

Article 5. Subjects of population census

Subjects of population census are: respondents;

the state bodies performing preparation and carrying out population census;

census personnel;

users.

Article 6. Respondents

Respondents are citizens of the Republic of Belarus, foreign citizens and stateless persons, constantly or temporarily living or temporarily staying in the Republic of Belarus, and also the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus, but on date of population census temporarily staying in the territory of foreign states.

Do not treat respondents and population censuses the foreign citizens who are heads and the staff of diplomatic representations, consular establishments and other representations of foreign states, representative offices of the international organizations in the Republic of Belarus and the members of their families having privileges and immunities according to international treaties of the Republic of Belarus are not subject.

Article 7. Basic rights and obligations of respondents

Respondents have the right:

the nobility, their personal data by whom and as they will be used are for what purpose collected;

get acquainted with the schedules completed on them, and in the presence of mistakes (inaccuracies) - to specify the personal data included in schedules for the purpose of ensuring their completeness and reliability;

demand from census personnel of presentation of the corresponding certificate, and in case of refusal in presentation of such certificate not to answer the questions containing in the schedule.

Respondents not interfere with carrying out population census and provide reliable personal data according to schedule form.

Article 8. The state bodies performing preparation and carrying out population census

Preparation and carrying out population census perform republican state body in the field of the state statistics and territorial authorities of the state statistics (further - bodies of the state statistics if other is not determined by this Law), and also other republican state bodies determined by Council of Ministers of the Republic of Belarus.

The republican state body in the field of the state statistics is actionee of the actions connected with preparation and carrying out population census.

Other republican state bodies determined by Council of Ministers of the Republic of Belarus are responsible for the organization of census of the separate categories of the population specified in article 20 of this Law, preparation of cartographic materials, streamlining of names of streets and numbering of houses, safety of census personnel, safety of schedules and other census documentation, implementation of other actions connected with preparation and carrying out population census.

The state bodies specified in part one of this Article interact in the field of population census with local executive and administrative organs which shall:

perform matching of temporary census personnel;
