This Law is aimed at providing legal, economic and organizational basis of state policy in the field of assistance of employment of the population, guarantees of the state on realization of constitutional right of citizens on work.
In this Law the following main terms and their determinations are used:
employment agency - the legal entity, the individual entrepreneur registered in the territory of the Republic of Belarus, rendering to citizens of service in assistance in employment and included in the Register of employment agencies (further - the Register);
unemployment - social and economic situation in case of which the part of able-bodied population wishing to work according to the employment contract, to perform activities for the civil agreement which subject are performance of works, rendering services, creation of intellectual property items (further - the civil agreement) and also other activities, revenue-producing cannot use the labor power;
the unemployed - the citizen of the Republic of Belarus, the foreign citizen and the person without citizenship who are constantly living in the Republic of Belarus, the foreign citizen and the stateless person to whom the statuses of the refugee or shelters in the Republic of Belarus (further, unless otherwise specified, - the citizen) which do not have work for which the salary shall be paid, not earning reward under the civil agreement, and also not performing other activities, revenue-producing which are registered in committee on work, employment and social protection of the Minsk city executive committee, management (department) of work, employment and social protection of city, district executive committee (further are provided - body for work, employment and social protection) for the purpose of search of suitable work, look for work and are ready to start it;
armor of employment - the minimum quantity of workplaces established by the Minsk city executive committee, city (the cities of regional subordination), district executive committees to employers for employment of separate categories of the unemployed and parents who shall refund the expenses spent by the state for content of the children who are on the state providing (further - the obliged persons);
the citizen who addressed concerning employment - the citizen who according to provisions of this Law cannot be registered by the unemployed, the foreign citizen and the person without citizenship petitioning for provision of the status of the refugee, additional protection or shelter in the Republic of Belarus and also the foreign citizen and the stateless person to whom additional protection in the Republic of Belarus is provided, registered in body for work, employment and social protection for rendering assistance in job search;
employment - the activities of citizens connected with satisfaction personal and public needs, which are not contradicting the legislation and bringing them the salary, remuneration under the civil agreement or other income;
quota for employment of disabled people - the quantity of workplaces percentage of payroll number of workers established by the Minsk city executive committee, city (the cities of regional subordination), district executive committees which the employer shall allocate and create for employment and employment of disabled people;
paid temporary works - the public work types which are carried out according to terminal employment contracts (except for contracts) or to civil agreements, having useful focus and organized as additional material support of the unemployed and citizens who addressed concerning employment;
bodies of public service of employment of the population - the Ministry of Labour and Social Protection, committees on work, employment and social protection regional, Minsk city executive committees, management (departments) of work, employment and social protection of city, district executive committees;
professional orientation (further - career guidance) - the component of system of career guidance of the population directed to assistance to professional self-determination and formation of the personality, rendering to the unemployed and citizens who addressed concerning employment, the practical help in choice of profession, change of occupation taking into account their capabilities, tendencies and requirements of the labor market;
the workers who are under the threat of dismissal - the workers who are subject to dismissal on the bases provided by Items 1 and 2 of Article 42 of the Labor code of the Republic of Belarus, or working at conditions of part-time at the initiative of the employer, or being on vacation without preserving or with partial preserving the salary provided at the initiative of the employer, or not working in connection with idle time not because of the worker;
free workplace (vacancy) - the employee's position (the worker's profession) provided by the staff list to which the worker according to the employment contract is not accepted;
subsidized workplace - workplace for employment of separate categories of the unemployed and citizens who addressed concerning employment, with partial compensation (financing) to employers of labor costs of such persons.
1. The relations in the field of assistance of employment of the population are governed by the legislation on employment of the population, and also the international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.
2. The legislation on employment of the population is based on the Constitution of the Republic of Belarus and consists of this Law and other regulatory legal acts governing the relations in the field of assistance of employment of the population.
3. If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
The Republic of Belarus performs international cooperation in the field of assistance of employment of the population with foreign states, the international organizations and interstate educations according to the procedure, established by the legislation, international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.
Operation of this Law extends to the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus, foreign citizens and stateless persons to which the status of the refugee or shelter in the Republic of Belarus are provided, and regarding employment - to the foreign citizens and persons without citizenship petitioning for provision of the status of the refugee, additional protection or shelter in the Republic of Belarus and also to foreign citizens and persons without citizenship to whom additional protection in the Republic of Belarus is provided.
Citizens are considered as busy:
working according to the employment contract or performing activities at legal entities and individual entrepreneurs for the civil agreement, except for the citizens occupied on paid temporary works in the direction of bodies for work, employment and social protection;
performing individual business activity;
performing child care aged up to three years, the handicapped child aged up to 18 years, the child aged up to 18 years infected with human immunodeficiency virus and also for the disabled person of the I group or person who reached 80-year age;
the Republic of Belarus passing the public civil service without execution of an employment agreement according to the Law of June 1, 2022 No. 175-Z "About public service";
the passing military service, service in paramilitary organizations or alternative service;
being founders (participants, members) of legal entities, except for founders (participants) of joint-stock companies and members of non-profit organizations;
being lawyers, notaries.
