1. Approve the enclosed Rules of compensation of part of costs of subjects of entrepreneurship in case of construction, reconstruction of objects of tourist activities (further - Rules).

2. To provide to committee of the industry of tourism of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within three working days after enforcement of this order placement it on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

3) within three working days after execution of the actions provided by this Item, submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of actions.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2022 and is subject to official publication.

Determine that the paragraph two of Item 11 of Rules is effective till May 1, 2024.

Rules of compensation of part of costs of subjects of entrepreneurship in case of construction, reconstruction of objects of tourist activities

Chapter 1. General provisions

1. These rules of compensation of part of costs of subjects of entrepreneurship in case of construction, reconstruction of objects of tourist activities (further – Rules) are developed according to subitem 20-15) of article 11 of the Law of the Republic of Kazakhstan "About tourist activities in the Republic of Kazakhstan" and determine procedure for compensation of part of costs of subjects of entrepreneurship in case of construction, reconstruction of objects of tourist activities (further – compensation of part of costs).

2. In these rules the following basic concepts are used:

1) local executive body – the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

2) construction activities (further – construction) – activities for creation of fixed assets of production and non-productive assignment by construction new and (or) changes (expansions, upgrades, modernization, reconstruction, restoration, major repair) the existing objects (buildings, constructions and their complexes, communications), mounting (dismantle), the related processing and plumbing system, production (production) of construction materials, products and designs, and also implementation of works on preservation of construction of incomplete objects and post-utilization of the objects which developed the resource;

3) reconstruction – change of certain rooms, other parts of the building or building in general, as a rule, connected with need of updating and upgrade of changeable object;

4) objects of tourist activities – the natural subjects and climatic zones, sights, historical and welfare subjects to display and other objects capable to satisfy needs of the tourist during the travel;

5) No. 353 is excluded according to the Order of the Minister of tourism and sport of the Republic of Kazakhstan of 29.12.2023

Chapter 2. Procedure for compensation of part of costs of subjects of entrepreneurship in case of construction, reconstruction of objects of tourist activities

3. For receipt of compensation of part of costs the subject of entrepreneurship in the location of the declared object of tourist activities sends to local executive body of area, city of republican value, the capital (further – MIO) the request for compensation of part of costs (further – the request) in form according to appendix to these rules in paper or electronic form by means of mail or purposely till March 1 of calendar year.

4. The subject of entrepreneurship applies to the request sent to MIO:

1) in case of application by the legal entity – copies of constituent documents of the legal entity, in case of filing of application by physical person – the copy of the identity document, the copy of the document confirming the beginning of activities as the individual entrepreneur, and in case of application by the representative of the subject of entrepreneurship in addition is submitted notarially attested power of attorney on representation of interests of the subject of entrepreneurship;

2) the copy of the act of acceptance of object of tourist activities in operation in the form approved by the order of the Minister of investments and development of the Republic of Kazakhstan of April 24, 2017 No. 234 "About approval of form of the acceptance act of object in operation" (it is registered in the Register of state registration of regulatory legal acts for No. 15141);

3) the copy of project (project and estimate) documentation on the declared object of the tourist activities having positive experimental testimony of projects according to the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities;

4) No. 353 is excluded according to the Order of the Minister of tourism and sport of the Republic of Kazakhstan of 29.12.2023

5) materials of photo and video fixing of the constructed, reconstructed declared object of tourist activities.
