About approval of the Procedure for provision of the state support of insurance of agricultural products

According to part seven of Article 20 of the Budget code of Ukraine and part one of article 26 of the Law of Ukraine "About features of insurance of agricultural products with the state support" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for provision of the state support of insurance of agricultural products which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for provision of the state support of insurance of agricultural products

1. This Procedure determines conditions of provision of the state support of insurance of agricultural products and the mechanism of use of the means provided by Minagropolitiki in the government budget according to the budget program "Financial Support of Agricultural Producers" for the state support of insurance of agricultural products (further - budgetary funds).

2. The main manager of budgetary funds and the executive in charge of the budget program is Minagropolitiki.

Receivers of budgetary funds are agricultural producers.

3. The state support is provided to agricultural producers - legal entities, irrespective of legal form and pattern of ownership and to physical persons entrepreneurs (further - insurers):

against which proceedings on bankruptcy which are not declared by bankrupt are not initiated, are not at liquidation stage;

which have no on the first in which the decision concerning implementation of payments, the debt on payments delayed more than six months, control of which collection is imposed on bodies of GNS, will be made;

which are not carried to legal entities or physical persons to which special economic and other rationing measures (sanctions), are applied by the relevant decisions of the National Security and Defense Council of Ukraine enacted by the Presidential decree of Ukraine about application of personal special economic and other rationing measures (sanctions) according to the Law of Ukraine "About sanctions";

which concluded with the insurer having the right to insurance of agricultural products with the state support (further - the authorized insurer) the insurance contract of agricultural products with the state support (further - the insurance contract);

which paid to the authorized insurer insurance premium (insurance payment) (further - insurance premium) for the insurance contract.

4. The state support of insurance of agricultural products is performed by compensation to insurers of part of the paid insurance premiums according to the insurance contract (further - compensation).

Compensation is provided at the rate to 60 percent of cost of insurance premium.

The compensation amount which is provided on one insurer during the budget period cannot exceed 10 thousand sizes of the minimum wage established for January 1 of the corresponding year.

5. Compensation is provided on irretrievable basis to the insurers who paid insurance premiums to the insurer who is included in the list of authorized insurers according to terms of the contract of insurance.

Insurers who obtained license for activities on insurance on classes of insurance 8 and 9, determined by article 4 of the Law of Ukraine "About insurance" are included in the list of authorized insurers, and conform to requirements of the legislation, to the requirements established by regulatory legal acts of National Bank.

For inclusion in the list of authorized insurers insurers give in electronic or paper form to Minagropolitiki:

the statement for inclusion in the list of representatives of insurers (in the form established by Minagropolitiki);

the comfort letter of National Bank about compliance to requirements of parts two and the fourth article 4 of the Law of Ukraine "About features of insurance of agricultural products with the state support" and to the requirements established by regulatory legal acts of National Bank.

The documents submitted by insurers are registered in electronic document management system of Minagropolitiki in accordance with the established procedure.

6. Based on the submitted Minagropolitiki's documents includes insurers in the list of authorized insurers what within three working days reports to insurers about and will promulgate the relevant information on the official website of Minagropolitiki.

Failure to provide by the insurer the documents specified in Item 5 of this Procedure can only be the basis for non-inclusion of the insurer in the list of authorized insurers.

The list of authorized insurers is created by the declarative principle during the budget period without restrictions of term of submission of the relevant documents by the insurer.

Modification of the list of authorized insurers is performed by Minagropolitiki within five working days after submission of the relevant documents by the insurer.

The insurer has the right to begin insurance of agricultural products with the state support from the date of its inclusion in the list of authorized insurers and promulgation of the relevant information of Minagropolitiki.

7. For the purpose of providing the organizational actions (interaction) connected with realization of regulations of this Procedure, Minagropolitiki signs with authorized insurers the Memorandum of general cooperative principles (further - the Memorandum).

The memorandum is signed for a period of up to the end of the current budget period with possibility of automatic prolongation of term of its action for the next budget period, disregarding cases of submission by the authorized insurer of the statement for voluntary termination of the Memorandum or loss by the authorized insurer of compliance to requirements of paragraph two of Item 5 of this Procedure.

8. The National Bank within 10 working days from the date of factual determination of discrepancy of the authorized insurer to requirements of parts two and the fourth article 4 of the Law of Ukraine "About features of insurance of agricultural products with the state support" is reported by Minagropolitiki about factual determination of such discrepancy.

Based on the message of National Bank of Minagropolitiki excludes such authorized insurer from the list of authorized insurers and breaks off with it the Memorandum what within five working days reports to the authorized insurer about.
