1. Approve the enclosed Instruction about procedure for opening and account management in precious metals.

2. Recognize invalid:

the resolution of Board of National Bank of the Republic of Belarus of July 25, 2002 No. 144 "About approval of Rules of opening and account management in precious metals" (The national register of legal acts of the Republic of Belarus, 2002, No. 96, 8/8439);

the resolution of Board of National Bank of the Republic of Belarus of April 24, 2004 No. 61 "About entering of amendments and changes into Rules of opening and account management in precious metals" (The national register of legal acts of the Republic of Belarus, 2004, No. 75, 8/10954).

3. This resolution becomes effective after its official publication.

The instruction about procedure for opening and account management in precious metals

Chapter 1. General provisions

1. This Instruction establishes procedure for opening and maintaining by National Bank the Republic of Belarus (further - National Bank), banks and the non-bank credit and financial organizations of the Republic of Belarus of accounts in precious metals (further - metal accounts) in the territory of the Republic of Belarus, and also procedure for opening of metal accounts by National Bank, banks and non-bank credit and financial organizations and other legal entities, individual entrepreneurs and physical persons of the Republic of Belarus in banks and other credit institutions beyond its limits.

2. In this Instruction following terms have the following value:

authorized banks and the non-bank credit and financial organizations - head departments of National Bank on areas, the banks of the Republic of Belarus created according to the legislation of the Republic of Belarus, having special permission (license) for implementation of banking activity with the right of banking operations on opening and account management in precious metals, purchase and sale of precious metals, to placement of precious metals in deposits (deposits), and their branches;

nonresident banks - the banks and other credit institutions created according to the legislation of foreign states, with the location outside the Republic of Belarus, having special permission (license) for making of transactions with precious metals if need of receipt of such special permission (license) is stipulated by the legislation the nonresident bank countries;

legal entities - residents - the legal entities created according to the legislation of the Republic of Belarus with the location in the Republic of Belarus irrespective of form of business (except for National Bank, authorized banks);

legal entities - nonresidents - the legal entities created according to the legislation of foreign states with the location outside the Republic of Belarus (except for nonresident banks);

legal entities are legal entities - residents and legal entities - nonresidents;

physical persons - citizens of the Republic of Belarus, foreign citizens, stateless persons;

precious metals - gold, silver, platinum, palladium (for National Bank also iridium, rhodium, ruthenium, osmium);

bank ingots - the gold bars, silver, platinum and palladium corresponding to the technical regulations or state standards on gold, silver, platinum and palladium existing in the territory of the Republic of Belarus in ingots, to requirements of the London association of participants of the market of precious metals (LBMA) or the London market of platinum and palladium (LPPM);

measuring ingots - gold bars, silver, the platinum, palladium conforming to standards of the state - producer of ingots;

weight in ligature - the actual lump of alloy of precious metal taking into account all components;

weight in purity - the mass of chemically net precious metal in alloy;

metal accounts the - the depersonalized, deposit, supplementary metal accounts intended for placement and accounting of gold, silver, platinum, palladium (for National Bank also iridium, rhodium, ruthenium, osmium);

the depersonalized metal account - the metal account intended for accounting of gold, silver, platinum and palladium in the form of bank ingots (for National Bank also in the form of fusible sponge, powder with net mass of metal % 99,90 suffices iridium, rhodium, ruthenium, osmium) without specifying of their individual signs;

the deposit metal account - the metal account intended for placement of precious metals in the form of the bank ingots attracted with National Bank, authorized banks at National Bank, authorized banks, nonresident banks, legal entities, physical persons on the terms of bank deposit (deposit);

the supplementary metal account - the metal account intended for placement of precious metals in the form of the measuring ingots attracted with authorized banks at National Bank, authorized banks, nonresident banks, legal litsrezident and legal entities - nonresidents, physical persons on the terms of bank deposit (deposit);

bank - the National Bank, authorized banks opening the metal account;

the client - person for whom the metal account is opened;

wire transfer of precious metals - write-off of precious metals from the metal account with simultaneous transfer of these precious metals into other metal account.

For the purposes of this Instruction the individual entrepreneurs registered and performing the activities in the territory of the Republic of Belarus treat the term legal entities - residents.

The terms "electronic document" and "card of open key of verification of the digital signature" have the values determined by the Law of the Republic of Belarus of December 28, 2009 "About the electronic document and the digital signature" (The national register of legal acts of the Republic of Belarus, 2010, No. 15, 2/1665).

3. Metal accounts in the territory of the Republic of Belarus are opened by National Bank (except metal accounts of physical persons) and authorized banks.

4. No. 394 is excluded according to the Resolution of RB National Bank of 26.09.2011
