1. Approve the Instruction about amount and procedure for collection, processing and storage of customer information of the operator of service of online borrowing and agreements signed by them it (is applied).

Chapter 1. General provisions

1. This Instruction determines amount and procedure for collection, processing and storage of customer information, signed the services agreement of the operator of service of online borrowing with the operator of service of online borrowing (further - clients of service), conditions and course of execution of the loan agreements of money signed by them (further - loan agreements) and the agreements signed in ensuring obligation fulfillment according to loan agreements (further - agreements in ensuring obligation fulfillment).

2. For the purposes of this Instruction terms are used in the values determined by appendix 1 to the Presidential decree of the Republic of Belarus of May 25, 2021 No. 196 "About services of online borrowing and leasing activities".

Chapter 2. Amount of customer information of service and signed by them agreements who are brought together, processed and the stored operator of service of online borrowing

3. The operator of service of online borrowing (further - service) collects, processes and stores the following customer information of service:

3.1. physical persons, except for individual entrepreneurs:

surname, own name, middle name (in the presence);

identification number, details of the identity document, birth date and birth place, floor;

nationality, three-digit digital country code (in case of its availability) according to the nation-wide qualifier of the Republic of Belarus OKRB 017-99 "The countries of the world" approved by the resolution of the State committee on standardization, metrology and certification of the Republic of Belarus of June 16, 1999 No. 8;

residence and (or) residence;

dates and results of all estimates of capability of the client of service performed by the operator of service to fulfill the agreement obligations of loan and (or) to the agreement in ensuring obligation fulfillment, including scoring estimates, and also assumed to financing of projects (in the presence);

category of the client of service (the borrower, the creditor, person performing obligation fulfillment of the borrower under the agreement in ensuring obligation fulfillment) according to each loan agreement signed by it, the agreement in ensuring obligation fulfillment, details (date, number) such agreements;

3.2. legal entities, individual entrepreneurs:

full name (surname, own name, middle name (in the presence) individual entrepreneur);

accounting number of the payer (for the nonresident - registration number (the code of the payer or analog of code of the payer appropriated according to the legislation of country of incorporation of the nonresident);

registration number and date of state registration in the Single state register of legal entities and individual entrepreneurs (for the foreign legal entity, the foreign organization, not being the legal entity on foreign law, the individual entrepreneur registered in foreign state - data on creation (registration) from the document confirming their status), the name of registering body (in the presence);

identification number, details of the identity document, nationality, birth date and birth place, sex of the individual entrepreneur;

location of the legal entity, residence and (or) residence of the individual entrepreneur;

types of activity according to the nation-wide qualifier of the Republic of Belarus OKRB 005-2011 "Types of economic activity" approved by the resolution of the State committee on standardization of the Republic of Belarus of December 5, 2011 No. 85;

the name of country of incorporation and digital country code (in case of its availability) according to the nation-wide qualifier of the Republic of Belarus OKRB 017-99 "The countries of the world";

category of the client of service (the borrower, the creditor, person performing obligation fulfillment of the borrower under the agreement in ensuring obligation fulfillment) according to each loan agreement signed by it, the agreement in ensuring obligation fulfillment, details (date, number) each agreement;

3.3. the services agreements of the operator of service signed by clients of service (further - services agreements):

details (date, number);

list of services in the services agreement;

the address of the website of the operator of service on the global computer Internet if it was used in case of the conclusion of the services agreement;

service type for access to which the services agreement (service of consumer online borrowing and (or) service of business online borrowing) is signed;

information on the authorized officer of the operator of service which signed the services agreement (surname, own name, middle name (in the presence), the name of position, type and details (date, number) the document confirming powers of the specified official on agreement signature of paid rendering services);

information about clients of service, being the agreement party of paid rendering services, including as a result of the conclusion of the agreement of accession, specified in paragraphs second and third subitem 3.1 or paragraphs the second or fifth subitem 3.2 of this Item;
