1. Approve "Procedure of payments of length of service for payment of allowances for years of continuous service to officials of customs authorities" it (is applied).

Procedure of payments of length of service of continuous service of officials

customs authorities and issued to them with respect thereto allowances

1. The procedure of payments of length of service of continuous service of officials of customs authorities and with respect thereto the allowances issued to them (further the Procedure) it is prepared on the basis of the Provision "About Service in Customs Authorities" approved by the Law of the Azerbaijan Republic of December 7, 1999 No. 768-IG, features of service in customs authorities and is established procedure of payments of length of service and issued to them with respect thereto allowances.

2. In days of continuous service of officials of customs authorities the stated below periods join:

- the term of the subsequent service, since day of position assignment in customs authorities;

- years of service of officials in the customs authorities which passed to the work connected with organizational and legal support of law enforcement agencies in bodies of the higher executive authority or legislature according to requirements of the corresponding regulatory legal acts with preserving in personnel of customs authorities and continued service in customs authorities after dismissal from these bodies;

- service life of officials in the customs authorities which continued service in these bodies after dismissal from bodies of the highest government;

- service life on positions of the officer, ensign, warrant officer and serviceman - the superconscript in Army of Azerbaijan and other militarized connections according to the legislation of the Azerbaijan Republic;

- service life of officials in the customs authorities working in other law enforcement agencies and... on emergency situations on positions of ordinary and administrative board, and also the judicial bodies which continued work in customs authorities after dismissal from these bodies with payment of allowances for years of continuous service;

- service life of officials in the customs authorities which served in law enforcement agencies of foreign countries and judicial bodies and after dismissal from these bodies in case of settlement by interstate agreements and other international documents accepted for continuation of service in customs authorities;

- study time in educational institutions of the State Customs Committee and educational institutions of foreign states in the direction of the State Customs Committee, passing of initial rates, retrainings and advanced training;

- discharge time from position of officials of customs authorities with preserving the salary;

- preserving term at the disposal of the State Customs Committee, dismissed in accordance with the established procedure in connection with holding organizational and regular actions with preserving regular actions;

- the periods of the provided annually main, additional, free and social vacations, the educational and sabbatical leaves granted for education and occupation by scientific activities, time of the vacation provided to graduates in connection with the termination of educational institutions of the State Customs Committee, other paid leave provided by the Labor code of the Azerbaijan Republic and the separation periods from work in cases of preserving place of employment and the average monthly salary of the worker;

3. The term of finding of officials of customs authorities under arrest, restrictions of freedom and stay in the organizations of serving sentence having the right to compensation of the caused damage as a result of mistake or abuse of official position of the body performing criminal procedure according to the legislation of the Azerbaijan Republic joins in length of service.

5. The cases provided by regulatory legal acts of the Azerbaijan Republic for calculation on favorable terms of length of service in other law enforcement agencies are considered when calculating length of service for payment of allowances for years of continuous service in customs authorities.

6. Prior to the day of approval of this Procedure the length of service calculated for payment of allowances for years of continuous service to officials of customs authorities cannot be changed.

7. The allowances provided to officials of customs authorities for years of continuous service are considered when calculating their average monthly salaries.

8. The length of service for payment of allowances to officials for years of continuous service affirms the relevant order on the basis of the conclusion of the commission created by the State Customs Committee.
