The protocol on single rules of import licensing and commodity export, and also the separate types of activity connected with it, state members of Eurasian economic community

of October 25, 2004

The governments of state members of Eurasian economic community (further - EurAsEC) which are hereinafter referred to as with the Parties for the purpose of further development of integration processes,

provided by the Agreement on the Customs union between the Republic of Belarus and the Russian Federation of January 6, 1995, the Agreement on the Customs union of January 20, 1995, the Agreement on the Customs union and the Common economic space of February 26, 1999 and the Constitutive treaty of Eurasian economic community of October 10, 2000,

realizing provisions of the Agreement on single measures of non-tariff regulation when forming the Customs union of October 22, 1997,

in view of intentions of the Parties on establishment by state members of EurAsEC of single trade regime concerning the third countries,

agreed as follows:

Article 1. Basic concepts

For the purposes of the this Protocol the following concepts are used:

foreign trade activity - activities for implementation of transactions in the field of foreign trade in goods, services, information and intellectual property;

the general license - the license granted to the participant of foreign trade activity based on the decision of the Party and granting the right of export or import of separate type of the licensed goods in the quantity determined by the license;

commodity import - commodity importation on customs area of state member of EurAsEC without obligation about the return export; the exclusive license - the license providing exclusive export right or import of separate type of goods;

the license and (or) permission - the special document on the right of implementation of import and (or) commodity export, or the separate types of activity connected with it;

licensing - the complex of administrative measures establishing procedure for provision of licenses and (or) permissions to the right of implementation of import and (or) commodity export or the separate types of activity connected with it;

observation - the temporary measure established for the purpose of monitoring of dynamics of import and (or) export of separate types of goods;

the one-time license - the license granted to the participant of foreign trade activity based on the foreign trade transaction which subject are the licensed goods, and granting the right of export or import of these goods in certain quantity;

allowing procedure - the procedure of the foreign trade transactions with separate types of goods providing licensing or other forms of administrative measures of regulation of foreign trade activity, and also customs control and customs clearance of such goods moved out of limits of the territories of state members of EurAsEC;

goods - the air, ocean ships which are subject of foreign trade activity personal estate, carried to real estate, inland navigation vessels and mixed (the river - the sea) swimmings and space objects, and also electrical energy and other types of energy.

The vehicles used under the agreement on international carriages are not considered in goods quality;
