About the budget of the national social insurance for 2022

The parliament adopts this organic law.

Art. 1. - The budget of the national social insurance for 2022 affirms according to the income in 34197925,4 amount thousand lei and on expenses as 34197925,4 amount thousand lei.

Art. 2. - (1) the Code of the budget of the national social insurance for 2022 is provided in appendix 1.

(2) Subprogrammes of expenses of the budget of the national social insurance for 2022 are provided in appendix 2.

Art. 3. - (1) the Fee of compulsory national social insurance in annual fixed amount (the annual fixed collection) added for the payers specified in Items 1. 6, 1.7 and 1.8 applications 1 to the Law on the state system of social insurance No. 489/1999, are installed in the amount of 12838 lei.

(2) the Fee of compulsory national social insurance in annual fixed amount (the annual fixed collection) added for the payers specified in Item 1.61 of appendix 1 to the Law on the state system of social insurance No. 489/1999, is established in the amount of 24255 lei.

(3) Voided.

(4) the Fee of the national social insurance in annual fixed amount (the annual fixed collection) for categories of persons which are not listed in appendix 1 to the Law on the state system of social insurance No. 489/1999 and which can be insured based on the individual agreement signed with National cash desk of social insurance is determined in the amount of 12838 lei a year, and for physical persons - owners or lessees of the farmlands processing the earth individually - in the amount of 3270 lei a year, but at least 1/12 corresponding amounts monthly that constitutes the insurance period included in insurance years of service for award of pension on age and benefits for burial.

Art. 4. - The penalty fee for delay of payments, the stipulated in Article 28 Laws on the state system of social insurance No. 489/1999, is established in the amount of debt percent 0,1 for each day of delay.

Art. 5. - (1) the Ministry of Finance transfers the financial funds provided by this law from the government budget in the budget of the national social insurance into the payment accounts of National cash desk of social insurance intended for social payments from the government budget.

(2) Social payments from the government budget are performed after transfer of the corresponding amounts from the government budget into the payment accounts of National cash desk of social insurance intended for social payments from the government budget.

Art. 6. - Types of social payments to some categories of the population which financing is performed at the expense of means of the government budget through National cash desk of social insurance are provided in appendix 3.

Art. 7. - (1) the Social payments provided from budget funds of the national social insurance to employees, the personality and which position fall under operation of the Law on the state secret No. 245/2008, are estimated and paid by the employer. The national cash desk of social insurance transfers to the employer the amounts necessary for payment of social payments, according to provisions of regulations.

(2) the Social payments provided to the persons which are in penal institutions having the right to these payments through the state system of social insurance are paid through penal institutions. Penal institutions sign in this regard the contract with National cash desk of social insurance.

(3) Social payments, except for provided by parts (1) and (2), provided to persons having the right to their obtaining through the state system of social insurance are paid by the payment method chosen by the receiver and which is available within the Government electronic payment service (MPay).

(4) Social payments are delivered to the house to elderly people, persons with limited opportunities and to persons who for health reasons cannot independently receive them in departments of payment service providers.

Art. 8. - (1) Payments on prevention of diseases and recovery of working ability of workers by sanatorium treatment in specialized agencies are financed by National cash desk of social insurance by budget funds of the national social insurance.

(2) the Organization of prevention of diseases and recovery of working ability of workers by sanatorium treatment is performed by National cash desk of social insurance with the assistance of labor unions and patronages according to the provision approved by the Government.

(3) the Organization of recovery of health by sanatorium treatment of receivers of payments through the state system of social insurance according to the Law on veterans No. 190/2003, and also the citizens who were injured owing to the Chernobyl catastrophic crash according to the Law on social protection of the citizens who were injured owing to the Chernobyl catastrophic crash, No. 909/1992, is performed by National cash desk of social insurance.

(4) the Organization of rest and improvement of children is performed by National cash desk of social insurance with the assistance of labor unions according to the provision approved by the Government.

Art. 9. - (1) Sales charges for services in issue of the social payments issued as the payments financed by means of the government budget and budget of the national social insurance shall not exceed the maximum value:

a) 0,4 of percent of the amount transferred into payment accounts;

b) 0,7 of percent of the amount issued by cash in cash desk;

c) 1,2 of percent of the amount issued by cash at home to receivers;

d) 0,25 of percent of the amounts issued by cash banks for payment through the state company "Posta Moldovei".

(2) the Sales charges specified in part (1), are compensated from the budget of the national social insurance to the government budget based on the agreement signed between the Ministry of Finance and National cash desk of social insurance.
