About multimodal transportations

This Law determines legal and organizational basis of multimodal transportations and is directed to creation of conditions for their development and enhancement, encouragement of use of more environmentally friendly modes of transport for the purpose of environmental protection, mitigation of climate change and overconsumption of energy.

Article 1. Determination of terms

1. In this Law the stated below terms are used in such value:

internal multimodal transportation - multimodal transportation without crossing of frontier of Ukraine;

the agreement of multimodal transportation – the contract between the operator of multimodal transportations and the customer of service of multimodal transportation for provision of service of multimodal transportation;

the document of multimodal transportation of goods - the carriage document (the way bill, the bill of lading, etc.) confirming the conclusion of the agreement of multimodal transportation and acceptance of load under responsibility with the operator of multimodal transportation from the customer who is drawn up by the operator of multimodal transportation and which performs cargo hauling;

the single carriage document - the document of multimodal transportation of goods of the established form on which multimodal cargo hauling on all route of multimodal transportation can be performed;

the customer of service of multimodal transportation - physical person or legal entity which under the agreement of multimodal transportation independently or through the representative acting from his name orders to the operator of multimodal transportation provision of service of multimodal transportation;

combined transport of loads - multimodal transportation of goods by the same transport unit without transhipment of cargo when changing mode of transport where the most part of route is the share of sea, river or rail transport, and route piece road transport is the shortest;

route of multimodal transportation - the way of cargo hauling defined by the agreement of multimodal transportation;

the international multimodal delivery - multimodal transportation with crossing of frontier of Ukraine;

multimodal transportation - transportation of goods by two or more modes of transport based on the agreement of multimodal transportation which is performed according to the document of multimodal transportation;

the multimodal terminal - production transshipment facility of any pattern of ownership which is used during multimodal transportation for change of modes of transport of accomplishment of transactions of loading, unloading, storage of loads, and in case of international delivery can also be the check point (control Item) through frontier of Ukraine;

the operator of multimodal transportation - subject of managing which signs the agreement of multimodal transportation accepts for shipment under the responsibility load, processes the document of multimodal transportation and performs or provides implementation of cargo hauling to the destination;

service of multimodal transportation - the organization and ensuring multimodal transportation for the agreement of multimodal transportation;

transport unit - the container, demountable body, trail car, semitrailer truck, and also the cargo vehicle or the rail car provided that they are transported (follow) other modes of transport without transhipment of cargo;

participants of multimodal transportation of goods are multimodal transport operators transportation, customers of service of multimodal transportation, the actual carriers, owners of multimodal terminals or subjects of managing in whose ownership and use on legal causes there are multimodal terminals, the third parties involved in rendering service of multimodal transportation;

the actual carrier - legal entity or physical person which on a contract basis undertook obligations and responsibility for delivery to the destination of the load entrusted it and issue to the representative on receipt of load to person specified in the document of multimodal transportation of goods or the transportation agreement of load.

Article 2. Coverage of this Law

1. This Law regulates the legal relationship arising between participants of multimodal transportation during provision of service of multimodal transportation.
