About some questions of the Ministry of digital development of the Kyrgyz Republic

According to the Presidential decree of the Kyrgyz Republic "About structure and structure of the Cabinet of Ministers of the Kyrgyz Republic and structure of Administration of the President of the Kyrgyz Republic" of October 12, 2021 425, articles 13 and 17 of the constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides No.:

1. Approve:

1) Regulations on the Ministry of digital development of the Kyrgyz Republic according to appendix 1;

2) the scheme of management of the Ministry of digital development of the Kyrgyz Republic according to appendix 2;

3) Regulations on Service on regulation and supervision in communication industry under the Ministry of digital development of the Kyrgyz Republic according to appendix 3;

4) Regulations on Archive agency under the Ministry of digital development of the Kyrgyz Republic according to appendix 4;

5) Regulations on Department of registration of the population and acts of civil status under the Ministry of digital development of the Kyrgyz Republic according to appendix 5;

6) Regulations on Public institution "Unaa" under the Ministry of digital development of the Kyrgyz Republic according to appendix 6;

7) the Charter of the State company "Infokom" under the Ministry of digital development of the Kyrgyz Republic according to appendix 7;

8) The charter of the State company "Kyrgyz of Pochtasa" under the Ministry of digital development of the Kyrgyz Republic according to appendix 8.

2. Bring in the order of the Government of the Kyrgyz Republic "About streamlining of activities of the state companies" of September 11, 2019 No. 468 the following change:

- to add Item 5-2 after the words "under the Ministry of Finance of the Kyrgyz Republic" with the words "and the state companies under the Ministry of digital development of the Kyrgyz Republic".

3. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of the Ministry of digital development of the Kyrgyz Republic" of June 1, 2021 No. 17 the following changes:

- to recognize subitems 1 and 2 of Item 3 and Item 5 invalid;

- to recognize appendices 1-8 to the above-stated resolution invalid.

4. To the ministry of digital development of the Kyrgyz Republic in accordance with the established procedure:

- in a month to submit for consideration of the Cabinet of Ministers of the Kyrgyz Republic projects of regulatory legal acts for the purpose of reduction in compliance with this resolution;

- take the necessary measures following from this resolution.

5. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

6. This resolution becomes effective after seven days from the date of official publication.

Regulations on the Ministry of digital development of the Kyrgyz Republic

1. General provisions

1. The ministry of digital development of the Kyrgyz Republic (further - the Ministry) is the state body of the executive authority developing and realizing state policy in the field of digitalization, electronic control in the sphere of use of the digital signature, the state and municipal electronic services, systems of identification, ensuring equal access to digital technologies, electric and mail service, including radio - and television broadcasting (further - communication), registration of the population, automotor-vehicles and trail cars to them, special technological machines, driver's structure, acts of civil status, archiving, cyber security (within competence of the Ministry).

2. The ministry in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic, resolutions of Jogorku Kenesh of the Kyrgyz Republic, resolutions and orders of the Cabinet of Ministers of the Kyrgyz Republic, international treaties which became effective according to the legislation of the Kyrgyz Republic, and also this Provision.

3. The ministry performs the activities in interaction with state bodies, local government bodies, public associations, scientific and other organizations, the companies, organizations.

4. The ministry in case of implementation of the obligations following from international treaties acts as post administration of the Kyrgyz Republic, administration of communication of the Kyrgyz Republic.

5. The ministry has the status of the legal entity, has seal with the image of the State Emblem of the Kyrgyz Republic, with the name in the state and official languages, stamps and forms of the established sample, and also the account in system of Treasury.

6. Full trade name of the Ministry:

- in state language: "Kyrgyz Respublikasynyn Sanariptik to ministrliga onukturu";

- in official language: "Ministry of digital development of the Kyrgyz Republic".

2. Purpose of the Ministry

8. The purpose of activities of the Ministry is development and realization of single state policy in the sphere of digitalization, ensuring development of electronic control, use of the digital signature, the state and municipal electronic services, development and providing high-technology information and communication infrastructure, systems of identification, ensuring equal access to digital technologies for the purpose of creating favorable conditions for digital development of the Kyrgyz Republic, digital transformation of public administration, and also integration of the Kyrgyz Republic into universal information and technological space, electric and mail service, including radio - and television broadcasting, in the sphere of registration of the population, automotor-vehicles and trail cars to them, special technological machines, driver's structure, acts of civil status, archiving, cyber security (within competence of the Ministry).

3. Tasks of the Ministry

9. Tasks of the Ministry are:

1) creating favorable conditions for:

- implementations and developments of information technologies, electronic control, archiving, networks and communication services;

- forming of common information space of the Kyrgyz Republic;

- forming of single infrastructure of the digital signature for the unified rendering legally significant state and municipal electronic services, ensuring interdepartmental information exchange;

2) providing:

- digital transformation of public administration, single architecture of electronic control, implementation of information and communication technologies in activities of the state bodies and local government bodies of the Kyrgyz Republic promoting provision of the state and municipal electronic services for citizens and business of the Kyrgyz Republic, and also integration of communications infrastructure of the Kyrgyz Republic with the international communication networks;

- developments and forming of single state registration and accounting system with use of modern information technologies;

- safety and protection of the state information and registration resources, information systems and networks which are in competence of the Ministry;

- the information security of personal nature referred to competence of the Ministry;

- functioning and developments of the unified state register of the population;

3) prevention and identification of threats of cyber security, response to computer incidents;

4) implementation of other tasks assigned to the Ministry according to the legislation of the Kyrgyz Republic.

4. Functions of the Ministry

10. The ministry performs the following functions:

1) functions of development of industry policy:

- develops and realizes single state policy in the field of digitalization, electronic control, the digital signature, electronic document management, rendering the state and municipal electronic services, electronic licensing, storage centers and data processing;

- develops and realizes single state policy in the field of archiving, registration of the population, automotor-vehicles and trail cars to them, special technological machines, driver's structure, acts of civil status;

- develops and realizes single state policy in the field of electric and mail service;

- develops projects of regulatory legal acts and decisions of the Cabinet of Ministers of the Kyrgyz Republic, and also takes part in preparation of the specified acts on the questions entering competence of the Ministry;

- holds events for legal promotion in the sphere of the supervised industry;

- participates in development of technical regulations in the sphere of communication and electronic control, the state information and registration resources and technologies, in information security field of the state information resources;

- performs functions of the state customer of the state information systems and resources, scientific and technical and investing programs and projects in the field of electronic control and state registration;

- performs functions of the main manager and the receiver of means of the republican budget and other sources provided on development of communication, digitalization and electronic control;

2) functions of realization of industry policy:

a) functions in the sphere of international cooperation:

- performs cooperation in the sphere of communication, digitalization, the digital signature, electronic control, registration and archiving with the international organizations and other financial institutions according to the legislation of the Kyrgyz Republic;

- within competence develops drafts of international treaties, according to the assigned powers signs and provides their realization;

- within the competence represents and protects state interests of the Kyrgyz Republic in the relations with other states and the international organizations;

- participates in forming of investment policy in the field of digitalization, electronic control and communication, and also registration within the conferred powers;

b) functions in the sphere of information and communication technologies and the digital signature:

- creates single requirements in the field of development and deployment of software and hardware complexes, information systems and networks, the digital signature, including by development of necessary standards and technical regulations;

- acts as the owner of the state information systems and resources which are under authority of the Ministry;

- creates and realizes mechanisms for creation, functioning, development and administration of the integrated state information systems and networks, single state data-processing center, single system of electronic document management, single state system on registration of personnel, single system of financial management, single system of identification, system of interdepartmental electronic interaction, the state portal of electronic services, the portal of electronic licensing and other state information and information and registration systems and resources;

- participates in implementation of modern information and information and registration technologies, including regarding provision of the state and municipal services;

- provides development and deployment of software and hardware complexes, the state information and information and registration systems and resources, including the digital signature;

- provides forming, storage, use, development and safety of the state information and information and registration resources and systems which are under authority of the Ministry;

- provides technological consolidation of the isolated information systems of state registration and creation of single information and registration resource;

- provides and realizes single information and technological space for the benefit of ensuring information exchange of public authorities, including within rendering services in the sphere of state registration and ensuring access to the state information and registration systems;

- keeps the unified state public register of signature key certificates of certification centers;

- determines policy on realization of the State system of electronic messages providing delivery of electronic messages to the receiver with ensuring fixing of time, integrity, authenticity, authorship and confidentiality, effectual in law;

c) functions in the sphere of electric and mail service:

- develops mobilization plans of preparation of communication systems for actions for civil defense together with state bodies;

- constitutes the National plan of numbering of communication networks in the Kyrgyz Republic, determines procedure for distribution and use of resource of numbering and controls its accomplishment;

- develops the plan of frequency providing;

- creates conditions for ensuring observation of conditions and amount of use of networks and services of telecommunication public, and also for the omission of the international traffic in network of telecommunication public of the Kyrgyz Republic;

- determines samples, nominals and circulations of signs of post payment, post envelopes and cards, will organize their edition, distribution, and also approval of the thematic plan of the edition of signs of post payment;

- appropriates postal indexes to departments of mail service and the ranges of identification barcodes of mailings in the territory of the Kyrgyz Republic;

- establishes procedure for settlement, arbitration consideration and the conflict resolution arising between operators, services of telecommunication, the companies of mail service and users of communication services;

d) functions in the sphere of state registration and archiving:

- provides the organization of system of production, registration, accounting, issue, protection, storage and destruction of the personified documents of the state value, and also identity documents which are within the competence of the Ministry;

- provides the organization of system of registration of the population and acts of civil status, automotor-vehicles and trail cars to them, special technological machines, driver's structure;
