About additional measures for strengthening of control of program implementation of development of social and production infrastructure of the Republic of Uzbekistan and other state programs
For the purpose of timely, complete and high-quality program implementation of development of social and production infrastructure of the Republic of Uzbekistan, state programs financed by means of the consolidated budget and other centralized sources, ensuring target and effective use of means, and also further strengthening of mechanisms of control in this sphere:
1. Establish procedure according to which annually since 2022:
a) in case of development of the Development program of social and production infrastructure of the Republic of Uzbekistan (further - the Program) the next years:
the ministries, departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent together with hokima of areas (cities) and heads of sectors till April 1 study condition of social and production infrastructure, need of implementation of new projects and their placement, and also wide public opinion on the specified questions on places;
heads of the ministries and departments, the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokima of areas and the city of Tashkent till May 1 proceeding from recommendations according to the Jokargi Kenes of the Republic of Karakalpakstan and local Kengasha of People's Deputies make to the Prime Minister of the Republic of Uzbekistan project proposals, included in the Program, on the basis of the personal guarantee;
The Ministry of Finance till May 1 creates the means necessary for financing of design and exploration work, by customers;
The Cabinet of Ministers (A. Zh. Ramatov, D. A. Kuchkarov) till July 1 studies feasibility of projects implementation, offered for inclusion in the Program, and approves their preliminary address list in accordance with the established procedure;
heads of regions, spheres and industries take measures for carrying out till November 1 of examination of the project (preproject) project documentation, included in the preliminary address list, in accordance with the established procedure, the personal responsibility for carrying out this work is conferred on them;
b) until the end of calendar year the Program the next years affirms and competitions (tenders) for the projects included in it are announced. At the same time inclusion in the Program of projects which expertize of project (preproject) documentation was not carried out is not allowed.
2. Determine that since January 1, 2022:
a) implementation of expenses and performance of works at the expense of means of the consolidated budget and other centralized sources in cases is forbidden:
lack of certain source of financing;
lack of the project documentation (the working project, working documents, the design estimates) approved in accordance with the established procedure or preparation of the project documentation at the same time, that is in parallel with installation and construction works;
selection of the contract (project) organizations without carrying out tender (tender) (except as specified, provided by the Law "About Public Procurements");
b) the contracts signed without carrying out tender (tender) for construction contract works electronically are not registered Treasury of the Ministry of Finance and payments under the specified agreements are not made (except as specified, provided by the Law "About Public Procurements");
c) within projects implementation, financed by the public external debt (except for borrowings of the international financial institutions and the foreign government financial organizations), in SUE Center of Complex Examination of Projects and Import Contracts obligatory complex expertize is carried out:
the preproject documentation of projects cost in equivalent of 5 million US dollars and more and specifications on their development;
the tender documentation on purchase of goods (works, services) with cost in equivalent of 1 million US dollars and more;
import contracts cost in equivalent of 1 million US dollars and more, concluded without conducting complex examination of their tender documentation, and supplementary agreements to them;
d) examination of the preproject and tender documentation within the projects financed by borrowings of the international financial institutions and the foreign government financial organizations attracted on behalf of the Republic of Uzbekistan and under guarantee of the Republic of Uzbekistan will be organized by international cooperation and development Agency according to international agreements.
Subitems "v" and "g" of this Item are not applied to the projects refinanced through commercial banks at the expense of the public external debt.
3. Approve the offer of the Prosecutor General's Office, Service of state security and Audit Chamber on implementation of the new control system behind forming and program implementation of development of social and production infrastructure, the state programs financed by means of the consolidated budget and other centralized sources (further - State programs), and also target use of means within the specified programs. At the same time to form:
The republican headquarters on control and coordination of implementation of state programs in structure according to appendix No. 1;
regional staffs on control and coordination of implementation of state programs in standard structure according to appendix No. 2;
district (city) staffs on control and coordination of implementation of State programs in standard structure according to appendix No. 3.
Determine the main objectives of the Republican headquarters (E. T. Yuldashev), regional and district (city) staffs:
control of timely and full implementation of requirements of acts of the legislation for development and implementation of State programs;
control of all processes - from selection of projects for inclusion in State programs before forming of their preliminary address list, development and conducting examination of project (preproject) documentation and approval of programs, on district (city), regional and republican stages;
control of timely and transparent carrying out tenders (tenders), high-quality accomplishment of construction contract works and their implementation according to the project documentation, and also project completion at the scheduled time;
implementation of system control of timely financing of projects by their initiators (customers), target and effective use of budgetary funds;
establishment of strict control of non-admission of implementation of expenses and (or) performance of works on the projects which do not have certain source of financing, parallel accomplishment of development of the project documentation and installation and construction works, selection of the contract (project) organizations without carrying out tender (tender) (except as specified, provided by the Law "About Public Procurements");
