The governments of state members of Eurasian economic community (further - EurAsEC) which are hereinafter referred to as with the Parties, being guided by the Agreement on the Customs union and the Common economic space of February 26, 1999 and the Constitutive treaty of Eurasian economic community of October 10, 2000,
aiming at elimination of unreasonable restrictions in mutual trade,
considering mutual interest in providing security guarantees and quality of the imported products for life and human health, environmental protection,
agreed as follows:
For the purposes of this agreement the used concepts mean the following:
"single market circulation mark of state members of EurAsEC", "single sign of the address" - the designation serving for informing acquirers on compliance issued in the product circulation to requirements of technical regulations of EurAsEC;
"confirmation of conformity of products" - the documentary certificate of compliance of products to requirements of technical regulations of EurAsEC;
"products" - the result of activities provided in material and material form and intended for further use in economic and other purposes;
"the technical regulation of EurAsEC" - the document accepted within EurAsEC and establishing obligatory for application and execution of the requirement to products.
The single market circulation mark of state members of Eurasian economic community is applied to product labeling, conforming to requirements of technical regulations of EurAsEC.
The form and the size of single sign of the address, and also procedure for marking of products by it are established in regulations on single market circulation mark of state members of EurAsEC which affirm Interstate Council of EurAsEC (at the level of heads of governments).
Products marked by single sign of the address are implemented in the territories of state members of EurAsEC without renewal of the documents on confirmation of conformity processed according to the procedure, the EurAsEC established by the legislation of state member from which products arrive in the address (on realization).
This agreement does not raise the questions of application of sanitary, veterinary and phytosanitary measures when importing (export) of products from the territory of state members of EurAsEC.
Compliance to requirements of technical regulations of EurAsEC of products marked by single sign of the address shall be confirmed according to the procedure, the EurAsEC established by the legislation of that state member in which it is made.
Authorized bodies of the Parties inform each other on the revealed violations which arose in case of implementation of this agreement and take measures according to the legislation of the states in case of detection of discrepancy of products marked by single sign of the address, to requirements of technical regulations of EurAsEC.
Responsibility for product labeling by single sign of the address is born by the manufacturer (supplier) of products.
The disputes connected using or interpretation of provisions of this agreement, are permitted by consultations and negotiations between the Parties.
By agreement of the Parties the changes which are drawn up by separate protocols can be made to this agreement.
The either party can leave this agreement by the written notice of it of depositary. This agreement for this Party is terminated in 6 months from the date of receipt by depositary of such notification.
Depositary of this agreement is the Integration Committee of EurAsEC.
This agreement becomes effective from the date of receipt by depositary of the fifth written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.
It is made in Minsk on May 19, 2006 in one authentic copy in Russian. The authentic copy is stored in Integration Committee of EurAsEC which will send to each Party its verified copy.
