About approval of the Regulations on procedure for disclosure of information by non-bank financial institutions

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", to Articles 12, 12-1, 21, of 27, of 28, 29 Laws of Ukraine "About financial services and state regulation of the markets of financial services", for the purpose of ensuring accomplishment of functions by the National Bank of Ukraine on state regulation in the sphere of the markets of financial services in the limits determined by the Law of Ukraine "About financial services and state regulation of the markets of financial services" the Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on procedure for disclosure of information by non-bank financial institutions (further - the Provision) which are applied.

2. To non-bank financial institutions and legal entities which are not financial institutions, but have the right to provide separate financial services, state regulation and supervision of which activities is exercised by the National Bank of Ukraine, during:

1) four months from the date of entry into force of this resolution to bring the activities into accord with requirements of the Provision, except Item 23 of the Section II of Provisions;

2) four months from the date of the termination or cancellation of warlike situation in Ukraine to bring the activities into accord with requirements of Item 23 of the Section II of Provisions.

2-1. To non-bank financial institutions and legal entities which are not financial institutions, but have the right to provide separate financial services, state regulation and supervision of which activities is exercised by the National Bank of Ukraine which did not bring the activities into accord with requirements of the Provision according to the subitem 1 of Item 2 of this resolution in connection with introduction of warlike situation in Ukraine, to bring the activities into accord with requirements of the Provision within four months from the date of the termination or cancellation of warlike situation in Ukraine.

3. No. 85 "About ensuring implementation of powers and accomplishment of functions on state regulation and supervision in the sphere of the markets of financial services in questions of supervision of activities of participants of the markets of financial services" to exclude Item 27 of appendix to the resolution of Board of the National Bank of Ukraine of June 25, 2020.

4. Declare invalid Item 1 of the order of the National commission performing state regulation in the sphere of the markets of financial services, of April 19, 2016 No. 825 "About approval of the Regulations on disclosure of information by the financial organizations in the public information database about financial institutions and on websites (web pages) of financial institutions and about modification of the Regulations on the State register of financial institutions", registered in the Ministry of Justice of Ukraine on May 16, 2016 for No. 722/28852.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on procedure for disclosure of information by non-bank financial institutions

I. General provisions

1. This Provision is developed according to requirements of the Laws of Ukraine "About the National Bank of Ukraine", "About financial services and state regulation of the markets of financial services" (further - the Financial services act) and establishes amount and procedure for disclosure of information determined in Article 12, parts one and the fourth Article 12-1 of the Financial services act, non-bank financial institutions and legal entities which are not financial institutions, but have the right to provide separate financial services, state regulation and supervision of which activities is exercised by the National Bank of Ukraine (further - the supplier of financial services), by placement of information on all own websites of suppliers of financial services, and also in places of rendering services to clients.

2. Requirements of this provision do not extend to disclosure of information by the supplier of financial services as the issuer according to requirements of the legislation on securities and informing consumers of financial services about conditions and procedure for provision of financial services.

Requirements of this provision extend to legal entities who are not financial institutions, but have the right to provide separate financial services, regarding disclosure of information specified in subitems 1 - the 10th Item 7, Items 11, of the 13th Section II of this provision.

3. The National Bank of Ukraine (further - National Bank) has the right to apply to the supplier of financial services of corrective action in case of violation by the supplier of financial services of requirements of this provision according to the procedure, determined by the regulatory legal act of National Bank concerning application of corrective actions in the sphere of state regulation of activities in the markets of non-bank financial services.

4. The supplier of financial services shall observe requirements of this Provision during all term of stay in the State register of financial institutions.

5. Terms in this Provision are used in the values given in the Financial services act, the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" and other laws of Ukraine.
