Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of publishing activities.

Article 2. Legislation on publishing activities

The legislation on publishing activities consists of this Law and other acts of the legislation.

If international treaties of the Republic of Uzbekistan establish other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about publishing activities then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

circulation - quantity of the made copies of publishing products;

the edition - the information fixed on the material carrier in the form of the text and (or) the image, which underwent publishing processing, intended for production of publishing products;

publishing products - products made according to the edition, way of use of printing technologies of seal and (or) program and technological visualization tools;

publishing activities - set of the organizational, creative, production and other measures directed to preparation and appearance of editions.

Article 4. Basic principles of publishing activities

The basic principles of publishing activities are:

freedom of publishing activities;

promoting and increase in culture of reading;

copyright protection;

inadmissibility of abuse of freedom of publishing activities.

Article 5. Liberty principle of publishing activities

Subjects of publishing activities are independent in the activities, including in determination of subject, specialization, production cooperation, the choice of authors, determination of circulations, prices of publishing products, establishment of forms of bonds among themselves, with producers and suppliers, and also with other organizations.

The requirement from publishing houses of preliminary approval of materials, withdrawals or corrections of separate parts of the text is not allowed from officials of state bodies and public associations if they are not authors of the edition.

Censorship of the manuscripts and materials prepared for the edition is not allowed.

Article 6. Principle of promoting and increase in culture of reading

The state, publishing houses, manufacturers and distributors of publishing products promote public awareness and increase in culture of reading.

Promoting and increase in culture of reading are performed in the way:

assistance to forming of the favorable circle for promotion of reading and ensuring availability of socially important literature;

editions, distribution and promoting of the best works of classics of the national and world literature, and also ensuring their availability to readers;

forming in public consciousness of steady ideas of value and the importance of the book;

involvement in reading all segments of the population, first of all youth.

Article 7. Principle of copyright protection

The main objectives of copyright protection in publishing activities are ensuring compliance with copyright, and also counteraction to production and distribution of counterfeit products.

Article 8. Principle of inadmissibility of abuse of freedom of publishing activities

Production and (or) distribution of editions and publishing products in which contain is not allowed:

appeals to violent change of the existing constitutional system, territorial integrity of the Republic of Uzbekistan;

appeals to mass riots, and also to participation in the meetings, meetings, street processions and demonstrations which are carried out with violation of established procedure;

information containing threat to public order or safety;

propaganda for war, violence and terrorism, and also ideas of religious extremism, separatism and fundamentalism;

the data constituting the state secrets or other secret protected by the law;

information initiating race, racial, ethnic or religious strife;

the information including expressed in indecent form, showing disrespect for society, the state, the state symbols;

promotion of drugs, psychotropic substances and precursors;

promotion of pornography and instigation to suicide making;

information directed to inducement or other involvement of citizens, including minors in making of the illegal actions posing threat for their life and (or) health or for life and (or) health of other persons;

other information, production or distribution of which involves criminal and other liability according to the law.

Release and distribution of the editions and publishing products discrediting honor and advantage or goodwill of citizens which content can be considered as intervention in their private life is forbidden.

Chapter 2. State regulation in the field of publishing activities and the state support of publishing activities

Article 9. The main directions of state policy in the field of publishing activities

The main directions of state policy in the field of publishing activities are:

enhancement of regulatory framework;

development of public-private partnership in this area;

organization and development of scientific research;

preparation, retraining of personnel and increase in their qualification;

creating favorable conditions for investment attraction to the publishing sphere;

implementation of the state support of subjects of publishing activities;

creation of equal opportunities for subjects of entrepreneurship in the market of publishing services;

control of observance of requirements and conditions of implementation of publishing activities according to the legislation;

development of international cooperation.

Article 10. State regulation in the field of publishing activities

State regulation in the field of publishing activities is performed by the Cabinet of Ministers of the Republic of Uzbekistan and authorized state body in the field of publishing activities.

Article 11. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of publishing activities

Cabinet of Ministers of the Republic of Uzbekistan:

provides realization of single state policy in the field of publishing activities;

provides development, approval and implementation of state programs in the field of development of publishing activities;

develops and adopts within the powers regulatory legal acts in the field of publishing activities;

determines procedure for passing of notifying procedures in the field of publishing activities;
