About prevention of the threats of homeland security connected with excessive impact of persons who have the considerable economic and political importance in public life (oligarchs)

This Law determines legal and organizational basis of functioning of system of prevention of excessive influence of persons which has the considerable economic and political importance in public life (oligarchs), content and procedure for application of corrective actions to these persons.

The purpose of this Law is overcoming the conflict of interest caused by merge of politicians, media and large business, impossibility of use of the political power for increase in equities, ensuring national security of Ukraine in economic, political and information spheres, protection of constitutional rights and freedoms of the citizen, protection of democracy, ensuring the state sovereignty and prevention of cases of manipulation with consciousness of citizens by intentional misstatement of information for the sake of receipt of access to resources which belong on the property right to the Ukrainian people.

Article 1. Determination of terms

1. In this Law the stated below terms are used in such value:

1) the beneficiary - the physical person which independently or together with other persons directly or indirectly has the authorized capital or voting power in the legal entity or performs influence on management or activities of the legal entity through connected physical persons or legal entities, or performs decisive influence by realization of the right of control, ownership, use or the order of all assets or their share, and the rights of receipt of the income from activities of the legal entity, the right of the solving influence on forming of structure, results of vote of governing bodies, and also transactions which give the chance to determine the main conditions of economic activity of the legal entity, to make the decisions, obligatory to execution, having decisive influence on activities of the legal entity;

2) mass media - any of such subjects: printing mass media, Internet mass media, news agency, the subject of information activities in the field of television and broadcasting;

3) Internet mass media (Internet mass-media) - mass media which regularly distribute information in text, audiovisual or other form in electronic (digital) type on the Internet through the website under the settled name as the individualizing sign;

4) the controller of mass media - person who can perform decisive influence on management or activities of mass media directly or through other persons by realization of the rights of the beneficiary or irrespective of the status of the beneficiary to perform such influence on the basis of the agreement or any other method, including due to financing;

5) the connected person - person who directly or indirectly owns share (voting power) in the subject of managing, share or voting power in which it directly or indirectly owns or person concerning whom coherence, and also other person who is recognized the connected person according to the rules established by the Tax code of Ukraine is determined;

6) the representative of face included in the Register of persons who have the considerable economic and political importance in public life (oligarchs) (the representative of the oligarch) - physical person which holds meetings (conversations), communication by means of phone or electronic communication with public employees from name and/or for the benefit of the face included in the Register;

7) the public employee - person specified in part five of article 8 of this Law.

2. Other terms are used in this Law in such values:

the term "the subject of information activities in the field of television and broadcasting" - in the value determined by the Law of Ukraine "About television and broadcasting";

the term "printing mass media" - in the value determined by the Law of Ukraine "About printing mass media (press) in Ukraine";

the term "news agency" - in the value determined by the Law of Ukraine "About news agencies";
