About the technical regulation of the Eurasian Economic Union "About safety of fowl and products of its conversion"

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:

1. Accept the enclosed technical regulation of the Eurasian Economic Union "About safety of fowl and products of its conversion" (TR EEU 051/2021) (further - the technical regulation).

2. Determine that the technical regulation becomes effective since January 1, 2023, except for:

a) Item paragraph two 21, which becomes effective after development of the corresponding interstate (regional) standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the specified requirement, and their entering into the list of standards determined by item 4 of the Protocol on technical regulation within the Eurasian Economic Union (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014) (further - the Protocol);

b) Item paragraph two 57, which becomes effective after development of the corresponding interstate (regional) standard containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the specified requirement, and its entering into the list of standards determined by item 4 of the Protocol;

c) paragraph two of the subitem "v" of Item 104, which becomes effective after development of the corresponding interstate (regional) standards and their entering into the list of standards determined by item 4 of the Protocol.

3. Ask the Government of the Russian Federation to provide:

a) no later than 24 months from the effective date this Decision together with the governments of other state members of the Eurasian Economic Union taking into account paragraph two of Item 41 of the Procedure for development, acceptance, change and cancellation of technical regulations of the Eurasian Economic Union approved by the Decision of Council of the Eurasian economic commission of June 20, 2012 No. 48, preparation for adoption in accordance with the established procedure of the project of changes in the technical regulation regarding amendment by its regulations on classification of different types of products from fowl (except for canned food from meat (offal) of bird) depending on mass fraction of meat ingredients (meat, myasosoderzhashchy, meat and cereal, vegetable and meat products);

b) no later than 24 months from the effective date this Decision preparation of the interstate (regional) standard containing rules and methods of reference of products from fowl to meat, myasosoderzhashchy, meat and cereal or vegetable and meat;

c) preparation in accordance with the established procedure in the technical regulation regarding updating of the most admissible level of remaining balance of veterinary doxycycline medicine in fowl and admissible levels of indicators of nutrition value "protein" and "fat" for canned food from fowl for food of children 3 years (if necessary) on the basis of scientific reasons are more senior than changes.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

I. Scope

1. This technical regulation establishes obligatory for application and execution on customs area of the Eurasian Economic Union (further - the Union) requirements to the products of slaughter of agricultural bird and products of their conversion released on customs area of the Union, the requirement to processes of their production, storage, transportation (transportation), realization and utilization, and also the requirement to marking and packaging of products of slaughter of bird and products of their conversion for ensuring their free movement.

2. If concerning products of slaughter of bird and products of their conversion other technical regulations of the Union (Customs union) establishing safety requirements to them, requirements to processes of their production, storage, transportation (transportation), realization and utilization, and also the requirement to marking and packaging are accepted, products of slaughter of bird and products of their conversion, processes of their production, storage, transportation (transportation), realization and utilization, and also their marking and packaging shall conform to requirements of other technical regulations of the Union (technical regulations of the Customs union) which action extends to them.

3. This technical regulation is developed for the purpose of protection of life and health of the person, the environment, life and (or) health of animals, the prevention of the actions misleading consumers (acquirers).

4. Objects of technical regulation of this technical regulation are:

a) products of slaughter of agricultural bird and products of their conversion:

fowl;

offal of bird;

fats of bird food (fat raw, fat melted);

fowl of mechanical boning;

bone of bird food and products of its conversion;

leather of bird;

raw materials kollagensoderzhashchy birds and products of its conversion;

semifinished products from meat (offal) of bird;

culinary products from meat (offal) of bird;

sausages from meat (offal) of bird;

products from meat (offal) of bird;

canned food from meat (offal) of bird;

products dry of fowl;

broths;

products of slaughter of bird for baby food;

products from fowl for baby food;

b) production processes, storages, transportations (transportation), realization and utilization of products of slaughter of bird and products of their conversion.

5. Action of this technical regulation does not extend on:

a) the products of slaughter of bird and products of their conversion made by citizens in house conditions and (or) in personal subsidiary farms and also production processes, storages, transportations (transportation) and utilization of products of slaughter of bird and the products of their conversion intended only for private consumption and which are not intended for release into the stream of commerce on customs area of the Union;

b) specialized food products (except for products of slaughter of bird and products of their conversion for baby food);

c) food products in which according to compounding the mass of products of slaughter and meat products in total constitutes 50 percent or exceeds the mass of products of slaughter of bird and products of their conversion;

d) nutritional supplements and dietary supplements to food, medicines, forage, products which are not intended for the food purposes which are made with use or product-based slaughter of bird and products of their conversion;

e) the food products of the companies of food (public catering) made with use or product-based slaughter of bird and products of their conversion, intended for realization when rendering services and also implementation processes of such products;

e) food products in which according to compounding content of ingredients from fowl constitutes less than 5 percent.
