About enhancement of administration of electronic commerce and creating favorable conditions for its further development

For the purpose of ensuring execution of the tasks determined within open dialog of the President of the Republic of Uzbekistan with entrepreneurs who is carried out on August 20, 2021 on direct studying of problems and proposals of entrepreneurs and determination of the main directions of the subsequent development of entrepreneurship, and also support of activities of platforms in the field of electronic commerce and system implementation of payment under letters of credit:

1. Approve the offer of the Ministry of investments and foreign trade, the Ministry of Economic Development and reducing poverty and the Ministry of development of information technologies and communications on complete start since July 1, 2022 of complex of information systems of electronic commerce "Open digital ecosystem" (further - the Digital ecosystem).

Reorganize the Center of the electronic cooperation portal under the Ministry of investments and foreign trade into the Center of digital transformation under the Ministry of investments and foreign trade (further - the Center).

2. Assign the following additional tasks to the Center:

forming of the Digital ecosystem and execution of functions of her operator;

creation for platforms of electronic commerce of conditions of equal access to the client base and rendering services to them, irrespective of pattern of ownership, departmental and industry accessory, territorial arrangement;

ensuring carrying out calculations and payments from one personal settlement account and the guaranteed execution of contractual commitments of the parties (by the principle of the letter of credit) in connection with accomplishment of functions of the eskrou system of the Digital ecosystem.

3. Establish procedure according to which:

placement of information on sales of goods and services on the platforms of electronic commerce integrated into the Digital ecosystem is obligatory. At the same time the conclusion of transactions on purchase of goods and services without specifying of the price is not allowed;

for up to January 1, 2024 for operators of the platforms of electronic commerce integrated into the Digital ecosystem, the profit tax rate decreases by 50 percent;

according to articles 337 and 467 of the Tax Code of the Republic of Uzbekistan the reduced tax rates on the income tax and the receipts tax irrespective of inclusion or their non-inclusion in the National register of participants of electronic commerce are applied to the taxpayers performing electronic trading by goods (services).

To the Ministry of Finance in two-month time to introduce to the Cabinet of Ministers the bill providing modification and the amendments in the Tax code following from this Item.

4. Approve "Road map" on creation of "Open digital ecosystem" of electronic commerce according to appendix.

5. To provide to the center together with the State Tax Committee till July 1, 2022 the mutual integration of electronic databases allowing to report in real time data to tax authorities through the Digital ecosystem.

6. To the ministry of investments and foreign trade in two-month time together with the interested ministries and departments to make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this resolution.

7. National broadcasting company of Uzbekistan, to the Agency of information and mass communications together with the interested ministries and departments to provide wide explanation of essence and contents of this resolution, including through mass media and the Internet.

8. Assign to the first deputy minister of investments and foreign trade A. B. Voitov the personal responsibility for the effective organization of execution of this resolution.

Discussion of course of execution of this resolution, implementation of coordination and control of activities of the departments responsible for its execution to assign to the deputy prime minister of the Republic of Uzbekistan S. U. Umurzakov.
