About additional measures for further simplification of customs administration and procedures

According to the Presidential decree of the Republic of Uzbekistan of February 3, 2021 No. UP-6155 "About the State program on strategy implementation of actions in five priority directions of development of the Republic of Uzbekistan in 2017-2021 in "Year of support of youth and strengthening of health of the population", and also for the purpose of creation of new workplaces and increase in export volume due to increase in production of industrial output in the republic with use of the mode of conversion on customs area, implementations of system of direct sales to the third countries without import the DECIDES: Cabinet of Ministers

1. Take into consideration that in the State program on strategy implementation of actions in five priority directions of development of the Republic of Uzbekistan in 2017-2021 in "Year of support of the youth and strengthening of health of the population" approved by the Presidential decree of the Republic of Uzbekistan of February 3, 2021 No. UP-6155, implementation of the mechanism of issue of permission to implementation of transactions on conversion even in the absence of the foreign customer is provided in requirements of customs regime.

2. For the purpose of simplification of requirements to customs clearance of foreign raw materials and materials since August 1, 2021:

resolve transactions on conversion even in case of absence of the foreign customer in requirements of customs regime;

implement in practice new types of contracts in foreign trade on the export, import, realization and purchase allowing the subject of entrepreneurship to acquire raw materials from abroad, to realize it to any foreign partner after its conversion in the territory of the republic without customs payment;

permit the domestic export organizations to acquire products abroad and to realize it directly to the third countries without import;

implement procedure of monitoring of binding of the contract for import to the contract for export, and also bindings of the contract of purchase to the contract of realization;

determine that commodity importation term to the republic under the contract for import and registrations in customs regimes of customs warehouse, free warehouse, free customs zone, conversion on customs area, and also cannot exceed return of the money paid for them 180 days from the date of implementation of payments under these contracts;

determine that the term of receipt of revenue or the return commodity importation under the contract for export shall not exceed 180 days from the date of registration of goods in customs regime "re-export";

provide that return of the means paid under the contract of purchase or receipt of funds under the contract of realization cannot exceed 180 days from the date of implementation of payment under the contract of purchase. At the same time the size of the means which arrived under the contract of realization shall not be less than the size of the means paid under the contract of purchase.

3. Make changes and additions to the Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions approved by the resolution of the Cabinet of Ministers of May 14, 2020 No. 283, according to appendix.

4. To the State Customs Committee of the Republic of Uzbekistan together with the interested ministries and departments in two-month time:

enter changes into the Single electronic information system of the foreign trade transactions, proceeding from requirements of this resolution;

bring the regulatory legal acts adopted by them into accord with this resolution.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan on financial and economic questions and reducing poverty - the Minister of Economic Development and reducing poverty of Kuchkarov D. A. and the deputy prime minister of the Republic of Uzbekistan concerning investments and foreign economic relations - the minister of investments and foreign trade Umurzakov S. U.

Changes and additions made to the Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions approved by the resolution of the Cabinet of Ministers of May 14, 2020 No. 283

1. In Item 2:

third to state the paragraph in the following edition:

"contracts in foreign trade - contracts for export, contracts of purchase, contracts for import, the contracts of realization specified in this Item of the Provision";

the contract for import - the contract between the resident and the nonresident of the Republic of Uzbekistan providing purchase of goods for the room under customs regimes of customs warehouse, free warehouse, free customs zone, conversion on customs area and the subsequent sales of goods to other nonresident based on the contract for export;

the contract of purchase - the contract between the resident and the nonresident of the Republic of Uzbekistan for purchase of goods without their import to customs area or in case of transportation according to the procedure of transit".

2. In item 4:

add the subitem "a" with the paragraph of the following content:

"if the party which signed the contract in foreign trade and the party performing payment or receiving goods (works, services) under this contract with the buyer, and also the party which signed the contract in foreign trade and the party which signed the contract in foreign trade with the seller delivering goods (performing works, rendering services) under this contract, differ, they are specified in the contract separately";

in the subitem "e" of the word "it is specified in foreign currency" shall be replaced with words "it is determined by agreement of the parties";
