About procedure for inclusion of goods in the inventory and exceptions of goods from it

Based on paragraph two of subitem 1.10 of Item 1 of article 7 of the Law of the Republic of Belarus of January 8, 2014 No. 128-Z "About state regulation of trade and public catering" and subitem 6.49 of Item 6 of the Regulations on the Ministry of the anti-monopoly regulation and trade of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of September 6, 2016 No. 702, the Ministry of anti-monopoly regulation and trade of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for inclusion of the goods in the inventory which are subject to inclusion by subjects of trade in the inventory obligatory to availability for realization in the shopping facility, and exceptions of goods of it it (is applied).

2. This resolution becomes effective after its official publication.

The instruction about procedure for inclusion of the goods in the inventory which are subject to inclusion by subjects of trade in the inventory obligatory to availability for realization in the shopping facility, and exceptions of goods of it

1. This Instruction determines procedure for inclusion of goods in the inventory with indication of their quantity and versions which are subject to inclusion by subjects of trade in the inventory obligatory to availability for realization in the shopping facility (further – the inventory) for the shopping facility in which retail trade, depending on type and type of the shopping facility and the size of its floor space, and exception of goods of the inventory is performed.

2. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus "About state regulation of trade and public catering" are used.

3. Inclusion of goods in the inventory and exception of goods of it is performed based on offers regional and (or) Minsk city executive committees.

Regional and (or) Minsk city executive committees based on addresses of legal entities and individual entrepreneurs, including by results of the studying of the sales demand which is carried out by them on goods, send to the Ministry of anti-monopoly regulation and trade of the offer on inclusion of goods in the inventory and exception of goods of it (further, unless otherwise specified, - offers).

4. The offer on inclusion of goods in the inventory shall contain information:

about the producer (producers) of goods (the name, the location, surname, own name, middle name (if that is available) the head, number of contact telephone numbers, the e-mail address, the period of implementation of economic activity, and also other information on discretion);

about type (group, subgroup), the name of the goods offered for inclusion in the inventory, the main consumer properties of the goods offered for inclusion in the inventory;

about availability of the trademark registered in accordance with the established procedure;

about quantity of the made kinds of the goods offered for inclusion in the inventory;

about production volumes of the goods offered for inclusion in the inventory, seasonality of production of goods (if production has seasonal nature);

about the number of the signed agreements to deliver goods offered for inclusion in the inventory with the subjects of trade performing retail trade;

about scopes of supply of the goods offered for inclusion in the inventory on the domestic consumer market and for export;

about the delivery conditions of goods offered for inclusion in the inventory, supply logistics;

about the carried-out work on studying of the sales demand on the goods offered for inclusion in the inventory (further, unless otherwise specified, - the sales demand), in objects of trade of the republic, about results of studying of the sales demand on form according to appendix.

5. Regional and (or) Minsk city executive committees in ten-day time after receipt of information on results of studying of the sales demand from the legal entities and individual entrepreneurs performing production of goods send to the Ministry of anti-monopoly regulation and trade of the offer on inclusion of goods in the inventory with provision of information stated in item 4 of this Instruction, and line item of regional and (or) Minsk city executive committee about feasibility of inclusion of goods in the inventory.

6. The ministry of anti-monopoly regulation and trade has the right to initiate introduction regional and (or) Minsk city executive committees of offers on inclusion of goods in the inventory without observance of requirements of item 4 of this Instruction on the basis:

special social orientation of the goods (intended for children and teenagers, socially unprotected segments of the population, goods of medical and preventive appointment);

inclusions of goods in the list of projects on creation of the new productions having the determining value for innovative development of the Republic of Belarus;

inclusions of goods in the list of delivery of import-substituting consumer goods to the domestic consumer market approved by the Commission on questions of industrial policy under Council of Ministers of the Republic of Belarus;

inclusions of goods in the list of socially important goods, the prices for which are regulated according to the legislation on pricing;

it is lower than the level of decrease in share of sale by subjects of trade of goods of national production, established by criteria of food and homeland security of the Republic of Belarus.
