Declare invalid the Order of the Acting Minister of the industry and infrastructure development of the Republic of Kazakhstan of April 8, 2020 No. 189 "About approval of Rules of rendering the state service "Approval of the Project Documentation on Construction, Expansion, Reconstruction, Upgrade, Preservation and Liquidation of Hazardous Production Facilities" (it is registered in the Register of state registration of regulatory legal acts for No. 20371).

In the order of the Minister of Emergency Situations of the Republic of Kazakhstan of June 2, 2021 No. 256 "About introduction of amendments to some orders in the field of rendering the state services in the field of industrial safety" (it is registered in the Register of state registration of regulatory legal acts at No. 22938):

4. To provide to committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

5. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

6. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of approval of the project documentation on construction, expansion, reconstruction, upgrade, preservation and liquidation of hazardous production facility by the organizations operating hazardous production facility

Chapter 1. General provisions

1. These rules of approval of the project documentation on construction, expansion, reconstruction, upgrade, preservation and liquidation of hazardous production facility by the organizations operating hazardous production facility (further – Rules) are developed according to the subitem 105) of Item 16 of the Regulations on the Ministry of Emergency Situations of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 23, 2020 No. 701 and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for approval of the project documentation on construction, expansion, reconstruction, upgrade, preservation and liquidation of hazardous production facility by the organizations operating hazardous production facility, and procedure for rendering the state service "Approval of the project documentation on construction, expansion reconstruction, upgrade, preservation and liquidation of hazardous production facilities".

2. Approval of the project documentation on construction, expansion, reconstruction, upgrade, preservation and liquidation (further – the project documentation) hazardous production facilities is carried out for the purpose of establishment of compliance of the made project decisions to requirements of regulatory legal acts in the field of industrial safety.

3. The project documentation of the hazardous production facility placed within two and more areas and also strategic objects is approved with Committee of industrial safety of the Ministry of Emergency Situations of the Republic of Kazakhstan (further – Committee).

The project documentation of other hazardous production facilities is coordinated with territorial departments of Committee.

The project documentation of hazardous production facilities on objects of social infrastructure is coordinated with local executive bodies of areas, cities of republican and regional value, the capital (further – local executive bodies).

4. Approval of the project documentation of hazardous production facilities is performed according to the procedure of rendering the state service "Approval of the Project Documentation on Construction, Expansion, Reconstruction, Upgrade, Preservation and Liquidation of Hazardous Production Facilities".

5. In case of change of types, technologies, methods and (or) methods of the planned activities influencing ensuring industrial safety, the project documentation is subject to change with the subsequent approval according to the procedure according to these rules.
