1. Approve Administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities.

2. Recognize invalid:

the order of the Ministry of Energy of the Russian Federation of September 8, 2015 No. 620 "About approval of Administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities" (registration No. 39112) is registered by the Ministry of Justice of the Russian Federation on October 2, 2015;

the order of the Ministry of Energy of the Russian Federation of March 7, 2017 No. 164 "About modification of the Administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities approved by the order of the Ministry of Energy of the Russian Federation of September 8, 2015 No. 620" (registration No. 46806) is registered by the Ministry of Justice of the Russian Federation on May 24, 2017;

the order of the Ministry of Energy of the Russian Federation of October 23, 2017 No. 1006 "About modification of the Administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities approved by the order of the Ministry of Energy of the Russian Federation of September 8, 2015 No. 620" (registration No. 49606) is registered by the Ministry of Justice of the Russian Federation on January 11, 2018.

3. This order is effective till January 28, 2027.

Administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities

I. General provisions

Subject of regulation of regulations

1. The administrative regulations of provision by the Ministry of Energy of the Russian Federation of the state service in coordination of conclusion from operation of power generation facilities (further - Regulations) establish terms and the sequence of ministerial procedures (actions) performed by the Ministry of Energy of the Russian Federation (further - the Ministry of Energy of the Russian Federation) and his officials by provision of the state service in coordination of conclusion from operation of power generation facilities (further - the state service), and also determine order of interaction between structural divisions of the Ministry of Energy of the Russian Federation and their officials, interactions of the Ministry of Energy of the Russian Federation with applicants, other public authorities and the organizations in the course of provision of the state service.

2. Applicants on provision of the state service are owners or authorized representatives of owners planned (planned) to conclusion from operation (further - applicants):

a) the generating equipment of power plants, power lines class of voltage of 110 kV and more, the transformer (autotransformer) equipment the highest class of the rated voltage of 220 kV and more and means of compensation of jet capacity of 220 kV and more, carried to subjects to scheduling;

b) the power lines carried to subjects to scheduling, the equipment and devices of the power generation facilities which are not specified in the subitem "an" of this Item of Regulations - if by results of consideration by the subject of supervisory control of the statement for conclusion from operation of the specified subjects to scheduling the conclusion of the subject of supervisory control about possibility (impossibility) of conclusion of subject to scheduling from operation (further - the conclusion) containing conclusion about impossibility of conclusion from operation of the specified subjects to scheduling is issued;

c) power lines, the equipment and devices of the power generation facilities which are not subjects to scheduling which conclusion from operation leads to scope change of corrective actions of antiemergency or regime automatic equipment on 5 MW and more, to change of available capacity of the generating equipment (power plant) on 5 MW and more or to change of other technological parameters carried to subjects to scheduling - if by results of consideration by the subject of supervisory control of the statement for conclusion from operation of the specified power lines the equipment and devices of power generation facilities the conclusion containing conclusion about impossibility of conclusion from operation of the specified subjects to scheduling is issued.

Powers of the representative of the applicant shall be documented according to requirements of the civil legislation.

Further in the text of Regulations, the power lines specified in this Item, the equipment and structures of power generation facilities, jointly hereinafter are referred to as "subjects to scheduling".

Requirements to procedure for informing on provision of the state service

3. Information on the location and the working schedule, the address of the official site in Internet network and e-mail of the Ministry of Energy of the Russian Federation, about telephone numbers for enquiries of the structural division providing the state service is posted on the official site of the Ministry of Energy of the Russian Federation in Internet network, in federal state information system "The federal register of the state and municipal services (functions) (further - the federal register) and on the Single portal of the state and municipal services (functions) (further - the Single portal), and also at information stands of the Ministry of Energy of the Russian Federation.

4. Informing applicants concerning provision of the state service, about the course of provision of the state service is performed:

in the form of written informing by placement of information at information stands of the Ministry of Energy of the Russian Federation and on the official site of the Ministry of Energy of the Russian Federation in Internet network;

in the form of oral informing in case of the request of applicants for information in the Ministry of Energy of the Russian Federation by phone;

in the form of written informing in case of receipt of appeals of applicants to the Ministry of Energy of the Russian Federation (the answer goes to the applicant no later than 30 calendar days from registration date of the specified address with indication of surname, initials and position of person which signed the answer, and also surnames, name, middle name (in the presence) and phone numbers of the contractor in time);

in the form of the direction of data on the course of provision of the state service on the e-mail address of the applicant specified in the application for conclusion of subject to scheduling directed to the Ministry of Energy of the Russian Federation from operation (further - the statement).

5. On the official site of the Ministry of Energy of the Russian Federation in Internet network, on the Single portal and at information stands in the Ministry of Energy of the Russian Federation the following information is placed:

a) the exhaustive list of the documents necessary for provision of the state service, the requirement to execution of the specified documents, and also the list of documents which the applicant has the right to provide on own initiative;

b) circle of applicants;

c) term of provision of the state service;

d) results of provision of the state service, procedure for submission of the document which is result of provision of the state service;

e) data on gratuitousness of provision of the state service;

e) the exhaustive list of the bases for suspension or refusal in provision of the state service;

g) about the applicant's right to pre-judicial (extrajudicial) appeal of actions (failure to act) and the decisions made (performed) during provision of the state service;

h) the forms of statements used by provision of the state service.

6. The refusal in reception of an application, and also refusal in provision of the state service is not allowed if the statement and other documents necessary for provision of the state service are submitted according to information on terms and procedure for provision of the service published on the official site of the Ministry of Energy of the Russian Federation in Internet network on the Single portal and at information stands to the Ministry of Energy of the Russian Federation.

II. Standard of provision of the state service

8. The state service is provided to the Ministry of Energy of the Russian Federation.

Direct provision of the state service performs Department of operational management in energy industry (further - authorized department).

9. The organizations participating in provision of the state service:

a) System Operator of the Unified Energy System of Russia;

b) subjects of supervisory control in power industry in technologically isolated territorial electric utility systems;

c) Market Council;

d) the network organizations owning on the property right or other legal cause by power generation facilities on which realization of technical actions for possibility of conclusion of subject to scheduling from operation is provided;

e) the subjects owning on the property right or other legal cause by power generation facilities on which realization of technical actions for possibility of conclusion of subject to scheduling from operation is provided.

It is forbidden to demand from the applicant of implementation of actions the, including coordination necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations, except for receipts of the services included in the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services, No. 352 approved by the order of the Government of the Russian Federation of May 6, 2011 (The Russian Federation Code, 2011, No. 20, Art. 2829; 2020, No. 39, Art. 6038).

10. Is result of provision of the state service:

a) the decision of the Ministry of Energy of the Russian Federation on coordination of conclusion of subject to scheduling from operation made according to Item 74 of Regulations and the notification of the applicant on possibility of conclusion of subject to scheduling from operation in the date which is earlier approved by the Ministry of Energy of the Russian Federation according to Item 132 of Regulations;

b) the decision of the Ministry of Energy of the Russian Federation on coordination of conclusion of subject to scheduling from operation made according to the subitem "an" of Item 130 of Regulations;

c) the decision of the Ministry of Energy of the Russian Federation on suspension of conclusion of the subject to scheduling which is part of the facility for production of electrical energy (capacity) functioning as a part of Power pool system of Russia, from operation and continuation of its operation, accepted according to the subitem "an" of Item 105 of Regulations;

d) the decision of the Ministry of Energy of the Russian Federation on suspension of conclusion from operation of the power lines relating to subjects to scheduling, the equipment and devices which are part of the objects of electric grid economy functioning as a part of Power pool system of Russia, and continuation of its operation accepted according to the subitem "i" of Item 105 of Regulations;

e) the decision of the Ministry of Energy of the Russian Federation on suspension of conclusion from operation of the subject to scheduling functioning as a part of technologically isolated territorial electric utility system, and continuation of its operation accepted according to the subitem "k" of Item 105 of Regulations.

The term of provision of the state service, including taking into account need of the appeal to the organizations participating in provision of the state service, the term of suspension of provision of the state service if the possibility of suspension is stipulated by the legislation the Russian Federation, the term of issue (direction) of the documents which are result of provision of the state service

11. The term of provision of the state service is estimated from the date of receipt of the Ministry of Energy of the Russian Federation of the statement and other documents necessary for provision of the state service according to Item 56 or 57 of Regulations.

12. The term of provision of the state service cannot exceed 135 calendar days.

The term of suspension of provision of the state service is determined according to requirements of Inference rules of power generation facilities in repair and from operation, approved by the order of the Government of the Russian Federation of January 30, 2021 No. 86 (The Russian Federation Code, 2021, No. 6, the Art. 985) (further - Rules).

The decision on coordination of conclusion of subject to scheduling from operation according to the subitem "an" of Item 10 of Regulations goes to the applicant within 3 working days from the date of acceptance of the Ministry of Energy of the Russian Federation of the specified decision, but no later than 30 calendar days from the date of receipt of the Ministry of Energy of the Russian Federation of the conclusion according to Item 63 of the Regulations containing conclusion about possibility of conclusion of subject to scheduling from operation.

The notification on possibility of conclusion of subject to scheduling from operation goes to the applicant not later than 5 working days before date since which according to earlier made decision of the Ministry of Energy of the Russian Federation, according to the subitem "an" of Item 10 of Regulations, conclusion of subject to scheduling from operation was approved to the date which is earlier approved by the Ministry of Energy of the Russian Federation.
