Chapter 1. General provisions

Article 1. Coverage of this Law

1. This Law governs the relations connected with production on confiscation of property of illegal origin, establishes the bases for studying, circle of bodies, competent to initiate productions on confiscation of property of illegal origin and to perform studying, rules of international cooperation in connection with confiscation of property of illegal origin, and also governs the other relations connected with confiscation of property of illegal origin.

Article 2. The legislation regulating confiscation of property of illegal origin

1. The relations connected with confiscation of property of illegal origin in the Republic of Armenia are regulated by this Law, the Code of civil procedure of the Republic of Armenia, the Civil code of the Republic of Armenia and other laws.

2. If this Law establishes other rules, than the Code of civil procedure of the Republic of Armenia, the Civil code of the Republic of Armenia or other laws, then the rules established by this Law are effective.

Article 3. The basic concepts used in the Law

1. In this Law the following basic concepts are used:

1) property - the property provided by part 1 of Article 132 of the Civil code of the Republic of Armenia including cryptoasset;

2) property of illegal origin - property, including one unit of property, several units of property or share of one unit of property which acquisition is not proved by the legal income according to the procedure, provided by this Law irrespective of whether it was acquired to or after entry into force of this Law, and also received from use of such property (fruits, products, the income);

3) the legal income - income gained in dramas of the Republic of Armenia, foreign currency in cryptoasset or in natural (non-cash) expression with observance of regulations of the applicable law determined according to Article 1277 of the Civil code of the Republic of Armenia without taxes and mandatory fees, including:

and. remuneration of work or other payments equated to it;

. compensation (royalty) and award received for right to use or uses of literary work, work in the field of art or scientific work from any copyright, any patent, the trademark, the project or model, the plan, confidential formula or process, for right to use of programs for electronic computers and databases or the industrial, commercial, scientific equipment or use of them or for provision of data on industrial, technical, organizational, commercial, scientific practice;

century the obtained loans (credits);

the percent received from the granted loans and other compensation;

dividends;

e. income (prizes) gained in gaming houses or in games with prize;

. ware or winnings (prizes) received in tenders or competitions and also in lotteries;

h. the property (also money) received according to the procedure of donation or the help;

and. the property (also money) received according to the procedure of inheritance;

to. insurance indemnities;

l. the income from business activity;

m the income from property acquisition;

N payment or other compensation for lease,

lake lump sum payments;

the item the income from property rights;

river the income from other civil agreements;

page pension;

t. the income from realization of agricultural products or from implementation of agricultural activities;

4) the crime provided by this Law - the act made in the territory of the Republic of Armenia or beyond its limits which contains actus reus signs, stipulated in Article 183, Article 188, Article 189, parts 3-4 Articles 210, Article 218, Article 219, Article 220, Item 3 parts 3 Articles 252, part Items 1 and 3 3 Articles 253, part Items 1 and 3 3 Articles 254, Item 2 of part 2 or part 3 (if it is made with use of imperious or office powers or the influence caused by them) or part Items 1 and 2 3 Articles 255, Item 2 of part 2 or part 3 (if it is made with use of imperious or office powers or the influence caused by them) or part Items 1 and 2 3 Articles 256, parts 1 and 2 of part 2 Articles 257, part 3 Articles 258, Article 267, Article 274, Article 275, Article 276, Item 3 of part 2 or part 3 of Article 282 (if it is made with use of imperious or office powers or the influence caused by them), Item 2 of part 2 or part 3 of Article 284 (if it is made with use of imperious or office powers or the influence caused by them), Article 291, Article 296, part 2 or 3 of Article 298, part 2 or 3 of Article 299, Article 308, Article 310, part 2 Articles 318, part 2 Articles 319, Item of 1 part 2 Articles 320, Item of 1 part 2 Articles 321, Article 322, Article 323, Article 324, Article 325, Article 331, part 3 Articles 335, Article 340, Article 393, Article 394, Article 399, Article 435, Article 436, Article 437, Article 438, Article 439, Article 440, Article 441, Article 442, Article 443, Article 444, Article 445, Item 2 parts 2 Articles 486, part 3 of Article 486 (if it is made with use of imperious or office powers or the influence caused by them), Article 482, Article 505 or article 549 of the Criminal code of the Republic of Armenia;;

5) the property belonging to person - property, which:
