About organization of some measures of support of employers and workers in sales terms of rationing arrangements in the period of COVID-19 pandemic

Based on Articles 78-1, 80 and 190-1 of the Labor code of the Republic of Moldova No. 154/2003 (The official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, DECIDES: the Government
1. For implementation of special measures on safety, protection of life and health of the population according to part (1) Article 190-1 of the Labor code of the Republic of Moldova No. 154/2003 employers - physical persons or legal entities of the public, private or mixed sector provide to workers two paid days off for each dose of vaccination against COVID-19 during action of emergency state in the field of public health.
1-1. The support measures provided in Articles 78-1 and 80 of the Labor code of the Republic of Moldova No. 154/2003, are applied to employers - physical persons or legal entities of the public, private or mixed sector.
2. Approve:
1) Regulations on provision from the government budget of benefit to the workers having children aged up to 12 years and children with limited opportunities to which the days off in case of suspension of educational process in the mode of physical presence, according to appendix No. 1 are provided;
2) Regulations on provision from the government budget of benefit for the technical idle time entered as a result of the announcement of emergency, obsidional and warlike situation, and the restrictions introduced in the conditions of emergency state in the field of public health according to appendix No. 2;
3) Regulations on provision from the government budget of compensation to workers for the purpose of realization of special measures on safety, protection of life and health of the population, according to appendix No. 3.
3. The government provides benefits and compensations from the government budget according to appendices No. 1, 2 and 3 only to employers of the private or mixed sector.
4. To the agency of electronic control, the Ministry of Finance and structures, and also National cash desk of social insurance subordinated to it to adapt information systems for implementation of provisions of this resolution.
5. Information center of National employment agency of the population (0 8000 1000) is contact telephone Item for assistance to employers and workers.
6. Expenses on provision of the benefits and compensations provided in Item 2, and on the necessary adjustments in information systems provided in Item 4, become covered from the government budget, including at the expense of transfers in the budget of the national social insurance.
6-1. The State Tax Service provides annually, till January 25, State Labour Inspection data from the automated system of single window of submission of reports on the employers and workers using privileges/compensations based on this resolution with breakdown on months. Provided information will be used for control of accomplishment of this resolution.
7. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

1. This Provision establishes the procedure of provision from the government budget of benefit to the workers having children aged up to 12 years and children with limited opportunities to which the days off in case of suspension of educational process in the mode of physical presence are provided (further - benefit) according to Article 78-1 of the Labor code of the Republic of Moldova No. 154/2003.
2. For the purposes of this provision the following basic concept is determined:
special measures for safety, protection of life and health of the population - the rationing arrangements established by orders of the Commission on emergency situations of the Republic of Moldova, the National extraordinary commission of public health or the territorial extraordinary commissions of public health in the period of COVID-19 pandemic.
3. This Provision is applied to the workers having children aged up to 12 years and the children with limited opportunities working at the companies to which the days off for baby sitting in case of suspension of educational process in the mode of physical presence in connection with introduction of special measures on safety, protection of life and health of the population are provided.
4. Provisions of Item 3 are applied to workers:
1) to parents or guardians of children aged up to 12 years registered in any educational institution;
2) to parents or guardians of the children with limited opportunities registered in any educational unit.
5. The benefit for the days off is provided to the workers specified in Item 4, according to the written application of one of parents or the guardian which is submitted to the employer. Except for single-parent families or the guardian who will exercise supervision of the child during the specified period workers enclose to the application for provision of the days off according to Article 78-1 of the Labor code of the Republic of Moldova No. 154/2003 the declaration under the personal liability that the benefit is requested by one of parents.
