About approval of Rules of marking of the packed water means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning the packed water

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of the packed water by means of identification.

2. Determine that participants of turnover of the packed water according to the Rules approved by this resolution:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement on their registration in information system of monitoring since September 1, 2021, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of the packed water of the activities connected with input in turnover, and (or) turnover, and (or) conclusion from turnover of the packed water concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover of the packed water not marked by means of identification (except for participants of turnover of the packed water is established, the provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" falling under action (further - participants of turnover of the packed water in the remote or remote areas);

at the same time participants of turnover of the packed water in the remote or remote areas perform the registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation by them of the activities connected with input in turnover, and (or) turnover, and (or) retail sale of the packed water;

b) provide no later than 60 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and passing of testing of information exchange electronically after registration in information system of monitoring send electronically to the operator of information system of monitoring the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of the packed water, its input in turnover, turnover and conclusion from turnover according to the Rules approved by this resolution no later than 30 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

a) participants of turnover of the packed water concerning the packed water (from code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (further - the commodity nomenclature) 2201 (including 2201 10), codes of the All-Russian Product Classifier by types of economic activity (further - the qualifier) 11.07.11. 110), performing input in turnover of the specified packed water, funds of identification for the specified packed water put and represent to information system of monitoring of the data on drawing means of identification and input in turnover of the specified packed water according to the Rules approved by this resolution since December 1, 2021;

b) participants of turnover of the packed water concerning the packed water (from code of the commodity nomenclature 2201 (including 2201 90 000 0), codes on the qualifier 11.07.11. 120, 11.07.11. 130, 11.07.11. 140, 11.07.11. 150), performing input in turnover of the specified packed water, funds of identification for the specified packed water put and represent to information system of monitoring of the data on drawing means of identification and input in turnover of the specified packed water according to the Rules approved by this resolution since March 1, 2022;

(1)) participants of turnover of the packed water concerning the packed water (from code of the commodity nomenclature 2201 and code on the qualifier 10.86.10.310), performing input in turnover of the specified packed water, according to the Rules approved by this resolution put funds of identification for the specified packed water and represent to information system of monitoring of the data on drawing funds of identification for the specified packed water and its input in turnover since September 1, 2023, and also data on turnover and conclusion from turnover specified the packed water since March 1, 2024;

c) participants of turnover of the packed water represent to information system of monitoring according to the Rules approved by this resolution, data on conclusion from turnover of the specified packed water by retail sale since March 1, 2023, data on turnover and data on conclusion from turnover in the way which is not retail sale, the specified packed water according to the Rules approved by this resolution since November 1, 2022;

d) participants of turnover of the packed water have the right to put funds of identification for the packed water and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, turnover and conclusion from turnover of the packed water according to the Rules approved by this resolution from the date of entry into force of this resolution;

e) participants of turnover of the packed water in the remote or remote areas have the right to provide the information specified in the Section VIII of the Rules approved by this resolution within 30 calendar days:

from the date of shipment (transfer or acceptance) the packed water by transfer (acceptance) of the packed water within the transactions providing transition of the property right to the specified goods and also within commission agreements and (or) agency agreements;

following behind day of conclusion of the packed water from turnover in case of conclusion of the packed water from turnover;

following behind day of return of the packed water to turnover in case of such return;

from the date of change of the data provided by Sections III, IV, VIII and IX of the Rules approved by this resolution in case of change of such data;

e) the participants of turnover of the packed water acquiring the packed water for use for the purpose of, not connected with its subsequent realization (sale) having the right not to represent to information system of monitoring of the data on conclusion from turnover of the specified packed water according to the Rules approved by this resolution till November 30, 2023 inclusive.

4. Determine that in the territory of the Russian Federation input in turnover of specific types of the packed water without drawing funds of identification for it and representation in information system of monitoring of data on marking of the packed water is allowed by means of identification before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for such packed water or representation in information system of monitoring of data becomes obligatory.

Release by customs authorities according to customs procedure of release for internal consumption or reimport of the unmarked packed water (from code of the commodity nomenclature 2201 and code on the qualifier 10.86.10.310) acquired till September 1, 2023 it is allowed till September 30, 2023 (inclusive).

Turnover and conclusion from turnover of the unmarked packed water made or imported into the Russian Federation (in case of its production out of the Russian Federation) before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for such packed water becomes obligatory are allowed before the termination of expiration date of this packed water.

5. Registration in the information system used for the purpose of ensuring carrying out experiment according to the order of the Government of the Russian Federation of March 27, 2020 with No. 348 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of the packed water", legal entities and individual entrepreneurs who as of June 1, 2021 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of the packed water to information system in which information support of carrying out experiment is performed do not meet the requirements of the Rules approved by this resolution, participants of turnover of the packed water represent to information system of monitoring missing and (or) urgent data before the corresponding date, the stipulated in Item 3 presents of the resolution.

6. Determine that the operator of information system of monitoring provides:

a) the organization of testing of information exchange of software and hardware of participants of turnover of the packed water and information system of monitoring no later than 30 calendar days from the date of obtaining from the participants of turnover of the packed water registered in information system of monitoring, the notification of the readiness to information exchange with information system of monitoring;

b) provision to participants of turnover of the packed water of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by the Rules approved by this resolution no later than 30 calendar days from the date of obtaining from the participants of turnover of the packed water registered in information system of monitoring, the request electronically for provision of remote access to the issue registration device.

7. Operation of this resolution does not extend to the packed water on which according to the Rules approved by this resolution, and international treaties of the Russian Federation requirements about obligatory marking by means of identification do not extend.

8. Determine that with approach of the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for specific types of the packed water becomes obligatory provision to the participant of turnover of the packed water of the codes of marking necessary for forming of means of identification, is performed by the operator of information system of monitoring on paid basis if other is not established by the Rules approved by this resolution.

If before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for consumer packaging of the packed water becomes obligatory on a grant basis were provided to the participant of turnover of the packed water by the operator of information system of monitoring the marking codes necessary for forming of means of identification, and the participant of turnover of the packed water did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input in turnover of the packed water before such date, such codes of marking are paid by the participant of turnover of the packed water or cancelled according to the Rules approved by this resolution.

9. This resolution becomes effective since September 1, 2021.

Rules of marking of the packed water means of identification

I. General provisions

1. These rules determine procedure for marking of the packed water which is subject to obligatory marking by means of identification (further - the packed water), requirements to participants of turnover of the packed water, procedure for information exchange of the participants of turnover of the packed water with the state information system of monitoring of turnover of goods who are subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification, and also procedure for representation by participants of turnover of the packed water of data to the operator of information system of monitoring on input in turnover, turnover and conclusion from turnover of the packed water.

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of consumer packagings of the packed water in group packaging of the packed water and (or) shipping package of the packed water, or shipping packages in shipping package of higher level of enclosure, or group packagings in shipping package with preserving information on interrelation of codes of identification of each enclosed consumer packaging with code of identification of the created group and (or) shipping package, about interrelation of codes of identification of each enclosed shipping package with code of identification of the created shipping package of higher level of enclosure, and also about interrelation of codes of identification of each enclosed group packaging with code of identification of the created shipping package and drawing appropriate means of identification on group packaging or code of identification of shipping package for the purpose of ensuring traceability of movement of the packed water on goods distribution chain without the need for opening of the created group and (or) shipping package;
