RESOLUTION OF THE CABINET OF MINISTERS OF THE KYRGYZ REPUBLIC

About creation of the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic

For the purpose of providing the operational solution of tasks of automation of the budget process, high-quality implementation of actions within digitalization of the state services in the sphere of management of public finances, effective management of state-owned property, fiskalization of tax procedures, customs administration, according to articles 13 and 17 of the constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Create the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic.

2. Approve the Charter of the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic according to appendix.

3. Bring in the order of the Government of the Kyrgyz Republic "About streamlining of activities of the state companies" of September 11, 2019 No. 468 the following change:

- add with Item 5-2 of the following content:

"5-2. Determine that operation of this resolution does not extend to the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic.".

4. Determine that the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic within three years has the right to direct the net profit got following the results of annual financial and economic activities to implementation of the strategic plan of development (business plan) in complete size.

5. This resolution becomes effective after seven days from the date of official publication.

The charter of the state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic

1. General provisions

1. The state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic (further - the Company) is the independent legal entity created in form of business of the state company founded on the right of economic maintaining by state-owned property.

2. The company in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic which came in the procedure established by the law into force international treaties which participant is the Kyrgyz Republic, and also acts of the Ministry of Finance of the Kyrgyz Republic and this Charter.

3. The constituent document of the Company is the Charter. Founder of the Company is the Cabinet of Ministers of the Kyrgyz Republic.

4. The state managing body of the Company is the Ministry of Finance of the Kyrgyz Republic.

5. The company has the trade name:

1) in state language: "Respublikasynyn Finansa's Kyrgyz ministrliginin aldyndaga of "Infosistems" mamlekettik ishkanasa";

2) in official language: "The state company "Infosistems" under the Ministry of Finance of the Kyrgyz Republic";

3) abbreviated name:

- in state language: "Infosistems" MI;

- in official language: GP "Infosistems".

6. The company operates on the principles of complete cost accounting and self-financing.

7. The company has the right to open in accordance with the established procedure settlement and other accounts, including currency, in commercial banks of the Kyrgyz Republic.

8. The company has seal with the name in the state and official languages, stamps, forms of the established sample and other attributes.

9. The company does not answer for obligations the Kyrgyz Republic, except as specified, when it assumed the guarantee (guarantee) according to obligations of the state.

10. The Cabinet of Ministers of the Kyrgyz Republic has the right to part of profit of the Company.

11. Legal address of the Company: 720010, Kyrgyz Republic, city of Bishkek, Erkindik Boulevard, 58 "a".

12. The company performs development and maintenance of information systems of state bodies in the sphere of the financial sector, fiskalization, customs and tax administration, trade, management of state-owned property, public procurements and other spheres (further - state bodies).

2. Purpose, tasks and functions of the Company

13. Main objectives of activities of the Company are:

1) implementation of state programs and socially oriented projects of all-republican value;

2) development and deployment of information systems of state bodies;

3) process control of automation of work of state bodies;

4) ensuring smooth functioning and maintenance of information systems;

5) provision of complex information and communication services in automation of business processes (development, implementation and maintenance of information systems).

14. The main objectives of the Company are:

1) goal achievement and execution of the functions specified in this Charter;

2) ensuring development, implementation and technical maintenance of products of the software for the state managing body;

3) development and deployment of projects in the sphere of electronic control, informatization, electronic state and municipal services, other digital applications;

4) ensuring smooth functioning of information system of state bodies;

5) ensuring integration of the automated information system of state bodies;

6) provision of information and communication services in automation of business processes (development, implementation and maintenance of information systems).

15. The main functions of the Company are:

1) development, implementation and maintenance of information systems for the state managing body;

2) coordination of works and project management in case of development and deployment of the created information systems independently and performed by the selected contractors;

3) technical maintenance and upgrade of the information systems of state bodies put into operation;

4) development and coordination of specifications;

5) implementation of integration of information systems of state bodies;

6) user training of information systems of state bodies in case of their operation;

7) ensuring work on user support of information systems of state bodies;

8) provision of consulting services in the field of information technologies to state bodies and other physical persons and legal entities;

9) training, preparation and retraining of personnel for development, maintenances and uses of information systems;
