About approval of Rules of carrying out accreditation of associations of subjects of private entrepreneurship

According to the subitem 22) the Government of the Republic of Kazakhstan DECIDES: parts one of Item 1 of article 98 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015

1. Approve the enclosed Rules of carrying out accreditation of associations of subjects of private entrepreneurship.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective since January 1, 2016 and is subject to official publication.

Rules of carrying out accreditation of associations of subjects of private entrepreneurship

1. General provisions

1. These rules of carrying out accreditation of associations of subjects of private entrepreneurship (further – Rules) parts one of article 98 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 are developed according to the subitem 22) (further – the Code) and establish procedure for carrying out accreditation of associations of subjects of private entrepreneurship.

2. Accreditation of associations of subjects of private entrepreneurship (further – associations) is recognition by the central state and local executive bodies (further – state bodies) compliance of associations of subjects of private entrepreneurship to the established criteria on representation of interests of subjects of private entrepreneurship in advisory councils concerning entrepreneurship.

3. Accreditations are subject:

1) at the republican level – republican associations of subjects of private entrepreneurship, republican cross-industry, branch associations, and also republican associations of subjects of small, medium and (or) big business;

2) at the regional level – regional associations of subjects of private entrepreneurship, regional associations of small, medium and (or) big business, branches of republican associations of subjects of private entrepreneurship;

3) at the city, district levels – regional, city, district associations of subjects of private entrepreneurship, regional, city, district associations of small, medium and (or) big business, branches of republican associations of subjects of private entrepreneurship.

4. If two and more consolidations representing one region, one industry apply for accreditation, the consolidation having in total the bigger number of workers in the subjects of private entrepreneurship which are members of this consolidation is subject to accreditation.

If two and more non-profit organizations representing one administrative and territorial unit, one field of activity apply for accreditation, the non-profit organization which has in total the bigger number of workers in the subjects of private entrepreneurship which are members of this non-profit organization is subject to accreditation.

5. Accreditation is performed by state bodies annually after publication of the announcement of terms and conditions of implementation of accreditation in the state and Russian languages.

When implementing accreditation at the republican level of the announcement are published in the periodic printing editions distributed in all territory of the Republic of Kazakhstan, or on the official sites of state bodies. Announcements of implementation of accreditation at the regional, city and district levels are published in the periodic printing editions distributed to the territories of the corresponding administrative and territorial unit, or on the official sites of state bodies.

6. For the purpose of objective and competent implementation of accreditation in each state body the commission on accreditation (further – the commission) which structure and the Provision affirm the decision of the head of state body is created.

2. Procedure for carrying out accreditation

7. For receipt of accreditation the applicant represents to state body:

1) the statement in form according to appendix 1 to these rules;

2) notarially attested copies of constituent documents and the certificate * or certificates of state registration (re-registration) of consolidation as the legal entity, in case of non-presentation of the original for reconciliation;

3) list of members of consolidation.

8. The procedure for carrying out accreditation includes the following stages:

1) placement by state body on Internet resource and in mass media of the announcement of the beginning of reception of applications on carrying out accreditation;

2) representation by associations of the statement and the document package provided in Item 7 of Rules;

3) consideration of accreditation materials by the commission;

4) adoption by state body of the decision on accreditation or refusal in accreditation;

5) issue of the certificate on accreditation or the written notice of refusal in accreditation with reasons.

9. The state body places on Internet resource and in mass media the announcement of the beginning of reception of applications on carrying out accreditation.

The associations applying for accreditation in state body within ten working days from the date of publication of the announcement represent document package, the Rules provided in Item 7.

10. Consideration of the materials provided by associations is performed on commission session according to which recommendations the state body makes the decision on issue of the certificate on accreditation or refusal in accreditation.

11. The term of consideration of documents and decision making about issue of the certificate on accreditation or refusal in accreditation shall not exceed fifteen working days from the moment of the termination of term of reception of applications.

12. In accreditation it can be refused cases if:

1) the submitted documents do not conform to requirements of Item 7 of these rules;

2) consolidation does not perform activities for protection of interests of his members;

3) the submitted documents contain the false or incomplete information.
