About the National strategy of development for intellectual property of the Republic of Tajikistan for the period till 2030

According to article 14 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" the Government of the Republic of Tajikistan decides:

1. Approve the National strategy of development for intellectual property of the Republic of Tajikistan for the period till 2030 it (is applied).

2. To the Ministry of economic development and trade of the Republic of Tajikistan together with the relevant ministries and departments to take necessary measures for implementation of the National strategy of development for intellectual property of the Republic of Tajikistan for the period till 2030.

3. To the Ministry of economic development and trade of the Republic of Tajikistan annually till February 10 to provide to the Government of the Republic of Tajikistan information on the course of realization of this Strategy.

The national strategy of development for intellectual property of the Republic of Tajikistan for the period till 2030

1. General provisions

1. Innovations (development on the basis of innovations in all spheres of social and economic life of the country) are one of three basic principles determined by the National strategy of development for the Republic of Tajikistan for the period till 2030 (further - HCP-2030), economies providing sustainable development. In turn, the most important priority of economic strategy of the Government of the Republic of Tajikistan in the innovative sphere is support of development of system of intellectual property and its commercialization.

2. The state supports the sphere of intellectual activities as the mechanism promoting economic development by forming of the strong regulatory legal base of protection of intellectual property rights, creating favorable conditions of development of innovative activities and simplification of system of intellectual property.

3. The government of the Republic of Tajikistan undertakes necessary measures in the direction of institutional transformations, structural reforms, forming of market infrastructure and favorable innovative climate in the country. All these tasks are formalized in the National strategy of development for intellectual property of the Republic of Tajikistan for the period till 2030 (further - Strategy).

4. Strategy determines prospects of national system of intellectual property, the purpose, specific measures and actions for their realization. Strategy is continuation of the National strategy of development for intellectual property of the Republic of Tajikistan for 2014-2020 approved by the order of the Government of the Republic of Tajikistan of June 3, 2014 No. 371.

5. Strategy is developed on the basis of the analysis of the current state of the sphere of intellectual property and determines further priorities and the prospects of development of national system of intellectual property. Basis of this Strategy constitute the provisions NSR-2030 on innovative development and stimulation of creative activities of citizens, including younger generation and youth.

6. The most important achievement of the National strategy of development for intellectual property of the Republic of Tajikistan for 2014-2020 is transition of questions of development of intellectual property from departmental level on state. If before department, engaged in various aspects of intellectual property, functioned it is isolated in the directions and did not interact with other concerned parties, then this process changed after creation of National council on coordination and development of the sphere of intellectual property. The national council headed by the deputy prime minister whose part representatives of the relevant ministries and departments are sets strategic objectives, considering state interests. Besides, considerable work on enhancement of the legislation in the field of intellectual property (changes and additions are made to the laws in 2016 and 2019) is carried out, the draft of the textbook on bases of intellectual property is developed, the training rates for students of institutions of higher professional education, conferences, tenders on increase in level of knowledge of youth and specialists in questions of creation, protection and use of intellectual property are organized.

7. Despite certain achievements, the intellectual property still did not become key factor in economic, social and cultural development of the country.

8. Development of innovations is closely connected not only with the level of science and technology in the country, but also legal are sewn up with degree results of intellectual activities, and also the level of the state support of the sphere of intellectual property. However it is necessary to resolve not only issues of protection of the rights, but also uses of intellectual property items, first of all the inventions which are the cornerstone of innovative development, forming of the new equipment and technologies.

9. One of the main objectives of Strategy is the reforming of national system of intellectual property promoting development of economic and creative capacity of the country and increase in its competitiveness in world economic system. Strategy shall determine the plan of transition from resource and raw model of economy to its innovative type when the essential share in economy is occupied by intellectual property.

10. The effective system of intellectual property, creation of the innovative circle in spheres of science, trade and education supported by the state shall include the following necessary main components:

- legislation: the legislation in the sphere of intellectual property, including part three of the Civil code of the Republic of Tajikistan, criminal, administrative, customs codes;

- institutional base: the infrastructure in the sphere of intellectual property consisting of set of the elements and relations provided for providing and proper functioning of system;

- activities: law enforcement or protection of intellectual property rights, management of intellectual property, assessment of intellectual property items, national branding, counteraction to offenses in the sphere of intellectual property and others;

- instruments of stimulation: complex of financial methods, moral and other instruments of stimulation of processes of creation and use of intellectual property items;

- social base: citizens as consumers of goods and services, creative specialists (innovators), and also the subjects of managing using intellectual property for creation of new workplaces and production of competitive products.
