1. This Procedure according to the Regulations on procedure for carrying out pre-judicial sanitation approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of July 26, 1999 No. 362, and Regulations on the State committee of the Republic of Uzbekistan on assistance to the privatized companies and the development of the competition approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of June 23, 2017 No. 419, determines the procedure of implementation of monitoring of process of pre-judicial sanitation and judicial sanitation (further - sanitation) the companies.
2. The purpose of this Procedure is systematization of process of carrying out monitoring of the sanified company for determination of efficiency of sanitation.
3. The state committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition and its territorial authorities (further - Committee) during all fixed term of sanitation perform monitoring of financial and economic activities of the company and determine efficiency of sanitation.
4. The main program document on monitoring of sanitation is the plan of financial improvement of the company approved by the owner, the participant, general shareholder meeting or creditors of the sanified company, approved with Committee
5. The business entity who received sanitation according to the decision of the Cabinet of Ministers of the Republic of Uzbekistan, board of Committee or economic court shall monthly, no later than the 5th following month under report to provide in Committee information on financial condition of the company for form according to appendix.
6. The committee on the basis of information provided by business entity carries out the analysis and monitoring (in dynamics) financial and economic activities according to its plan of financial improvement of the company for the accounting period.
7. The committee, on analysis results of information of the companies, constitutes the conclusion and prepares summary information on the course of sanitation of the companies which sends to the body which provided sanitation, for the 10th, following reporting quarter.
8. In case of factual determination of inefficiency of carrying out sanitation, Committee the conclusion about early termination of sanitation which is introduced to the body which provided sanitation for decision making prepares.
9. The head and the chief accountant of the company bear complete responsibility for reliability of results of financial and economic activities and timeliness of their submission to Committee.
10. In case of identification, in the course of sanitation of monitoring, wrongful acts which resulted in bankruptcy of the company, perpetrators are made responsible according to the legislation.
