About application of anti-dumping measure by means of introduction of anti-dumping duty concerning the graphitized electrodes coming from People's Republic of China and imported on customs area of the Eurasian Economic Union

According to Item 107 of the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries (and based on the report of Department of protection of the domestic market of the Eurasian economic commission the Board of the Eurasian economic commission solved appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29 (further - the Protocol):

1. Apply anti-dumping measure by means of introduction of anti-dumping duty in sizes according to appendix No. 1 to the electrodes imported on customs area of the Eurasian Economic Union used in furnaces, the graphitized round section with a diameter no more than 520 mm or other cross section no more than 2 700 cm ^{of 2,} of the CN FEA EEU coming from People's Republic of China and classified by code 8545 11 008 9, having established effective period of this anti-dumping measure of 5 years.

2. To provide to the state bodies of state members of the Eurasian Economic Union authorized in the field of customs affairs collection of the anti-dumping duty provided by this Decision, being guided both by code of the CN FEA EEU, and description of goods.

3. To department of protection of the domestic market of the Eurasian economic commission:

perform monitoring of observance of the recommended approaches to planning, negotiation and supply activity of the graphitized electrodes provided by "EPM — Novosibirsk Electrode Plant" joint-stock company, "EPM — Novocherkassk Electrode Plant" joint-stock company, Donkarb Graphite limited liability company in state members of the Eurasian Economic Union according to appendix No. 2 (further - the recommended approaches) and to inform Board of the Eurasian economic commission following the results of every half-year on its results;

in case of non-compliance by "EPM — Novosibirsk Electrode Plant" joint-stock company, "EPM — Novocherkassk Electrode Plant" joint-stock company, Donkarb Graphite limited liability company with the recommended approaches, including taking into account information which arrived from the consumer of state member of the Eurasian Economic Union, authorized state body of state member of the Eurasian Economic Union and also taking into account the stipulated in Item 4 presents of the Solution of monitoring to make repeated investigation (review) of the anti-dumping measure established by this Decision according to Item 110 of the Protocol, having provided non-use of the specified anti-dumping measure before completion of repeated investigation (review) according to Item 272 of the Protocol.

4. To department of anti-monopoly regulation of the Eurasian economic commission during action of the anti-dumping measure established by this Decision to perform monitoring of the prices in the goods market of the graphitized electrodes specified in Item 1 of this Decision, and on its results to inform Board of the Eurasian economic commission following the results of every half-year.

5. This Decision becomes effective since October 1, 2022.
